Hello folks,

I've been called recently to attend the interview on 25th Jan. 2011. Now we are dealing with filling out i-864. It feels kind of confusing.

My petitioning sponsor is my wife. We have no dependents or kids. I'm the only intending immigrant.

Part 2. Information on the principal immigrant. (I'm the only intending immigrant)

Part 3. Information on the immigrant(s) you are sponsoring.

8. (Checked YES)I am sponsoring the principal immigrant named in Part 2 above.

10. Enter the total number of immigrants you are sponsoring on this form from Part 3, Items 8 and 9. (1)

21. Your Household Size - DO NOT COUNT ANYONE TWICE

Part 5. Sponsor's household size.

Persons you are sponsoring in this affidavit:

a. Enter the number you entered on line 10. (1)

Persons NOT sponsored in this affidavit:

b. Yourself. (1)

c. If you are currently married, enter "1" for your spouse. (?)

This last item © is confusing me. Knowing my wife is married to me and i'm the sponsored person, if we put (1) , then the total of the household size would be (3) ? she's the petitioning sponsor and the only sponsored person on this i-864 affidavit. how is this?

Should i leave blank (0) or what? help please!

Your household size is 2. It says do not count anyone twice. I realize yes it's confusing. But this form is also used for people other than your spouse to sponsor you. So technically someone could have a spouse that is not the sponsored immigrant. Anyway, put a 0 for spouse since you are already listed as the immigrant.

02/21/99 Hubby entered with F1 student visa D/S

May 2002 He stopped attending school because he couldn't afford it any longer.

03?/2002 USC sibling I-130 petition

02/2009 Met hubby

08/2009 Sibling petition approved but ineligible to adjust status due to overstay

07/10 Married :)

11/22/10 [day 0]- mailed AOS packet!! should be there by noon 11/23/2010

12/3/10 [day 11]- received email/text notification of acceptance from USCIS

12/3/10 hubby surprised me with a trip to Los Angeles for my birthday...no problems :)

12/6/10 [day 14]- received hard copy NOA1 in mail

12/7/10 [day 15]- checks cashed...ouch

12/15/10 [day 23]- rec'd biometrics appt set for Dec. 28th at 10 am! :)

12/28/10 [day 36]- successful biometrics appt

01/27/11 [day 66]- rec'd interview appt set for March 10th at 10 am :)

02/25/11 [day 95]- rec'd EAD

03/10/11 [day 109]- Interview, Green card approved!! :)

Next Step: Removing conditions in 2 years.

Part 6. Sponsor's income and employment.

Item 25. Federal income tax return information.

My wife didnt file a tax return in 2007 as she barely turned 18 and was hard for her to find a job that early.

should we check the first line as it talks about us having filed the last 3 years taxes?

and if yes, should we include 2007 in the last bar and as of total income, we put ($0.00)- we have made a letter explaining why she didn't file in that year, 2007.

Okay, you have two options on #25. If you want to send transcripts for 2008 and 2009 (no 2007 since she had no income) then check mark the bottom box. If you are only sending transcripts (or tax returns) for 2009 then check mark the top box. Then you list all three years and yes put $0 for 2007 regardless of which box you check. If she didn't have income, she didn't have income. And your explanation will suffice. Good luck!
