Hello. Im a new member and the primary reason I have joined the community was to help some of my church members. I actually hail from Hawaii so I myself was fortunate enough to be born a citizen of the U.S. . But, anyway, here is my question. One of my church members has been trying to get a job with me. He was born in Mexico but lives here in the U.S. . He has no recollection of his life in Mexico at all. He has attended american schools grades k-12 and has recently graduated College with an associates degree in welding. So as you can see, he has lived here in the U.S. all of his life. My question is simple. How do I go about getting him hired on to the company in which I am employed? Any input would be greatly appreciated.

Simple, base on what you have written, apply for a job opening thru the company HR dept. Now if you wish to give more details as to why he can not do this simple task then the VJ community maybe able to give more solutions. I am not being un-helpful, only repying to what you have written.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hello. Im a new member and the primary reason I have joined the community was to help some of my church members. My question is simple. How do I go about getting him hired on to the company in which I am employed? Any input would be greatly appreciated.

You can hire the person through H1B process, It is depend on your friends education qualification and work experience. As you said he had degree on welding, So he should be work in the welding company.

I would suggest you to get a lawyer, They will fix your problem. For H1B process, you have to have lawyer to do the process.

Since you do not answer the pressing question regarding the young man's immigration status, let me outline three scenarios:

1) He entered the US without a visa, without inspection (EWI). In this case, he is a "illegal alien" and subject to deportation once caught. There is nothing you, his parents, President Obama, or even the almighty creator could do to change that, short of the DREAM ACT passing, which is anybody's guess.

2) He entered the US with a visa, but is out of status. In this case he is also illegally present at this time and also subject to deportation once caught. Having only an A.S. his only chance of becoming "legal" is by marriage to a US citizen, after which he could adjust status from non-immigrant to immigrant via a process called Adjustment of Status (AOS).

3) He has a Green Card. In this case you just hire him as Green Card holders a.k.a. Lawful Permanent Residents (LPRs) can do anything a US citizen can do, short of voting and serving as a juror.

So you see that the means of entry is the first major variable here.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . Thanks guys for all the swift replies. I dont really know how all this visa stuff works. At all. But im trying to learn. My friend has no papers whatsoever. No drivers license, no state I.D., nothing. He lives in the same town in which I reside in Texas. He has been working as a welder for about two years now. As stated earlier he has graduated from a pretty good tech. college (TSTC Waco) with an associates degree and does plan on continuing his education. I reallty would like for him to work with me here overseas as an american contractor. He is a very well mannered and motivated individual and I would really hate to see all that he has worked to become just go to waste. I hope the addition of info helps a little. If more is needed please dont hesitate to be specific with your questions. Thanks again guys and god bless.

You really need to ask him how he entered the USA, but from what you say, it sounds like he entered EWI (swam over the border or whatever). If so, there is no way to make him legal. As you say you live abroad, you might look into getting him a visa to wherever you are now, and then hire him as a local worker. Good luck!

It sounds as though your friend is, as countless others, in a terribly difficult situation. In almost all aspects, your friend is an American having lived and studied in the US for most of his life. Yet, he is not an American in the eyes of the law. Had the DREAM Act passed, there might have been hope for him (though you did not say his age), but currently, if he has no legal status and SSN, he cannot work (legally) for you or anyone else.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Where overseas.

Is a visa available for a welder? Most countries are no less restrictive than the US in letting foreign nationals work in their country.

He can not be an american contractor but he could be a Mexican Contractor.
