We mailed our packet today. Crossing my fingers it doesn't get sent back - tomorrow is the first day of our 90 day window...

We mailed out our I-751 with lots of evidence today . Hopefully, we would get the biometric letter in 3 weeks or less.Good luck to all the January I-751 filers.

hi all!

did you include tax return for 2010? I'm February 2011 filer, first week, and want to know if should I include tax return for 2010.

Seeing that we have time until half April for the 2010 tax return, I doubt many of us, either January or February filers, will actually send in the tax return for 2010. Some probably didn't even get their W2's yet, which makes them unable to actually file their taxes already.

I only send in our joint 2008 and 2009 tax. We do have everything ready for the 2010 tax return, but since I didn't want to rush that one (will start later this week on that), I just didn't add it. It's important enough that it gets filled in right. If I actually get an interview later, then I will take the 2010 return as proof as well as I should have it long ready by then, but for now I didn't send it in.

Well, as I promised in an earlier post, here's what we've send in with our petition today:

Registration of verbal court order in Dutch and sworn English translation, a supplement/explanation regarding what happened back then, an clarification regarding part 5 (children), copies of green card and passports, copy birth certificate of our daughter, partial copies of our joint 2008 and 2009 tax returns (2 pages federal, 1 page state per return), life insurance showing me as beneficiary, a partial bank statement, insurance papers for our cars, copies of our car registrations showing joint ownerships, car lease agreement and a car sales/finance agreement for the other car, my general excise tax license showing our address and copies of our driver licenses also for address verification, copy of health and dental insurance stuff, copies of airline boarding passes and a couple of pictures.

A total of 40 pages, the package itself weighed 11oz (about 0.6 lbs I believe). Personally I doubt they will ask for more proof of our ongoing relationship, I've seen people getting approved with less than this lol.

The main idea as to sending these items, USCIS would like to see an ongoing financial mingling. With these said, to my understanding people send in 3-4 bank statements a year for the last 2-3 years, utility bills-about 3-4 bills every year for the last 2-3 years for about 2-3 different utility companies. Health and dental insurance bills for the last 2-3 years, My point is showing proof everything was in both names for the last 2-3 years of marriage.

Well, that would be the safest way, I know.

But I didn't send any bank statement or utility bill (or affidavit) and got approved no problem.

So, don't worry JelloenAndMichelle, you'll be fine :)

Well, to be honest, my banking business is none of their business. It states nowhere I should give them that much insight into my financial stuff, it's not like they're the IRS or something. I have nothing to hide, that's not the issue, it just doesn't feel right to do it. If they specifically ask for more, they can get more, but it is the same account as they received a (also only one page) statement from during the AOS, which was about 2 years ago. If they compare those bank account numbers, they'll see nothing much has changed since then, they can only see it is still ongoing, anything more would just add to the weight but wouldn't prove more than it does now. The only thing they're concerned about is that we have our finances together and that we live on the same address, you can give them 1 or 100 pages, it's all the same in the end. Plus with all the other evidence, I think we showed pretty well that we have an ongoing relationship with shared finances and responsibilities (just take the car loan and the car lease for example... the money that goes around in there could also buy a house, just to name something). Heh, I could make it sound even worse in your ears: we have 3 shared checking and 1 shared savings account.. I only gave them a partial statement of our main checking account.

As for utility bills, we don't have any so that will be hard to produce. My wife owns 3 homes but we have no bills whatsoever on those houses due to our own specific situation. All those bills are in someone else's name as they pay for that. We could add ourselves, or even completely take over those bills, but for what point? If you want, you can even put some homeless person on a utility bill, it doesn't proof much as they will be paid for anyways (read that interview with an IO about the proof of an ongoing relationship, for example, he says the exact same thing and it makes perfect sense). We're not paying for them, it would actually be fraudulent to show them as proof in that case.

Same goes with other bills, such as telephone bills. My mother in law, for example, has a family plan with some of her friends. One of them gets the bill, they share the costs and they're all listed on that plan. However, they all live in different places and besides being friends, there is no relationship whatsoever.. That kind of shows how easily that evidence could be faked, doesn't it? And the USCIS knows that too.. utility bills, telephone bills and all that do help, but they're secondary evidence as they by them self alone don't prove much.

Well, that would be the safest way, I know.

I know, I did my homework and read a lot of things... there are a LOT of people who send much less than us, and they all got approved so I'm not worrying about that.. they only thing I slightly worry about, although not much (call it more or less an excitement) is my court thingie :)

And oh well, even if they send me an RFE, then what? It will not be the end of the world. I am already living together with my wife, it is not like I am waiting to get allowed into the US.. if we get an RFE, it will just take a bit longer, but the end result will be the same =)

I took it to the post office today, it's 4LBS actually! I copied all of our mortgage paperwork, 2 years of income tax, copies of utility bills, lots of envelopes/letters/cards addressed to both of us.... The more the better I think, rather than not enough and getting an RFE!

I kinda have thick files too so I put it in like a filing envelope with tabs in each page and sent it to USPS medium flat rate envelope.

We did not.Our 2010 tax return is not completed yet. I am waiting for 1099s, W2s and mortgage interests from the banks. Besides, form 1040 is not final yet. It would be final on 01/07/2011 and I mailed out our form I-751 on 01/05/2011. I am also a Tax Accountant. We included 2008 and 2009 joint tax returns. Since yours would not be mailed till February, you may include 2010 return if it is completed at that time. I efile our tax returns every year and efile does not start till January 14. Good luck.

efile does not start till January 14

Slowpokes there at the IRS lol, I noticed the efile date yesterday when I was wrapping things up... Oh well, it doesn't matter really, my taxes are done for now, all I need to wrap up is my depreciation stuff but the form I needed was not available last night. Same with the state tax forms, they will take about 2 more weeks before they're available... slowpokes, guess they don't like to pay me and my wife our refund xD

This is OT, but on your W-4 you can always increase the number of deductions you claim (so less taxes are withheld ), therefore reducing the amount of the refund you expect. In practical terms a tax refund is a 0% interest loan to the government, so the smaller the refund amount the better...cool.gif

BTW, I just checked my package via USPS Track and confirm, and it was received today, yay! Hopefully We will get our NOA1 soon!
