Needed to attach IRS returns to the I-134 used at time of K-1 visa interview, and then later needed to be attached to I-864 at time of adjustment of status.

If did not work all three years then past year or two is fine.

This is not needed when filing the I-129F, so will move this to consulate discussion.

What is diffrent between personal income tax and W2?

A W2 is a form issued by an employer stating what taxes were withheld, this form is then used when filing an IRS return, if tax withheld was more than needed, then a refund is issued.

The W2 will show gross income, which is what the consulate wants to see.

A W2 is a form issued by an employer stating what taxes were withheld, this form is then used when filing an IRS return, if tax withheld was more than needed, then a refund is issued.

The W2 will show gross income, which is what the consulate wants to see.

I do not have non of the above becasue I was going to school fulltime and I was babysitting. I did not have any taxes. Do I have to have these for interview? My income for this year will not count?

Th consulate can and does require seeing IRS returns.

If not filed, it is easiest to file ZERO returns for past years and attach them to the I-134 or I-864.

Th consulate can and does require seeing IRS returns.

If not filed, it is easiest to file ZERO returns for past years and attach them to the I-134 or I-864.

I have no body to sponsor. I worked part time last year. But this year I worked fulltime.Also I own a home for $145000 with a mortgage of $127000. I have enough income for this year, but not for the past 3 years as I told you I was a student. Do I have to have income for past 3 years to be not deined?

I have seen denials requesting co sponsors in cases where there is no past income reported.

I, too, would suggest you file NOW an income tax return with the income you had in 2008 and one for 2009, even if it was just a few bucks you made for babysitting. You won't owe any taxes but you still have the returns to show. If you have a decent income for 2010 and file early in January, you should be fine. You can also use the equity in your home at a rate of 1:3 if necessary to satisfy the income requirement.

Let's say you earned $18K this year, I suggest you show that you have also $18K equity in your home which is worth $6K for immigration purposes. If you made $28K or more, however, you won't have a problem at all.

I looked at my income w2 tax return for 2008 I made $8400 is that enough?

First, a W2 is not a tax return. It's a document you get from your employer that you include with the tax return you file with the IRS. A tax return consists of at least one of the various IRS 1040 forms, plus any schedules you are required to include, plus any supporting documents like W2's, 1099's, and 1098's. A copy of a tax return would be a copy of every form, schedule, and supporting document that was (or would have been) sent to the IRS when the tax return was filed. I say "would have been" because many people file electronically, and don't actually send any forms to the IRS.

At a minimum, most consulates will want a copy of your tax return from the most recent tax year. This does NOT necessarily mean the most recent tax return you filed. If you didn't file for the most recent tax year, which is currently 2009, then they aren't going to accept your 2008 tax return instead. If your income was too low to require you to file a return then you need to include a letter explaining this.

The consulate will also accept a tax return transcript from the IRS instead of a copy of the tax return. The transcript is simpler because you don't have to include any other forms or supporting documents, and you can get them free from the IRS.

Your present income will be taken into consideration, but the consular officer needs to be convinced that the intending immigrant will not become a public charge in the US. They are allowed to use their discretion in making this determination. However, they will almost never accept a sponsor who cannot show they have current income and/or assets of 125% of the poverty guidelines for their household size. If your household will consist only of you and your fiance then the minimum income level is currently $18,212 per year.

Many consulates will consider assets if you have a shortage of income. The assets are valued at 1/3 as much as income (e.g., $3000 in assets is equal to $1000 in income). You generally have to prove you own the asset, you have to prove it's current value (minus any liens or encumbrances), and there must be a reasonable assumption that you can convert the asset into cash within 12 months without undue hardship or financial loss.

If you intend to declare your home as an asset for the affidavit of support then you'll need to produce a copy of the deed or title (proof you own the home), a copy of a recent appraisal by a certified appraiser (proof of the homes value), and a copy of recent statements from your mortgage lender(s) (proof of the amount of liens and encumbrances). You'll subtract the mortgage payoff from the appraised value to determine the amount of equity you have. Divide that number by three to determine how much income will be offset by your equity.

A partial tax return is useless. If the 1040 and W2 for 2009 are everything that was included in his tax return, then a copy of that should be sufficient. Forget 2007 and 2008 - you don't have complete tax returns for those years.

Your fiance can call the IRS and get tax return transcripts for all three years. Five minutes on the phone, at no cost, and he'll get the transcripts within two weeks.

Thank you for your explaination.From my tax return in 2008 I made $8000 and in 2009 I made only $1000 becasue I was and I am a fulltime student. In 2010 I worked 6 months with an income around $1300-1500 each month. But I also own a home which is valued for $145000 with a $127000 mortgage on this house.Do I still need a sponsor?

You need to make $18,212 USD. You NEED a co-sponsor. Find someone you know, family member, close friend etc.
