THIS IS ANOTHER BAD NEWS FOR ALL F2A FROM AILA:

The Department of State's (DOS) January 2011 Visa Bulletin retrogressed the cut-off dates for a number of family-based categories (AILA Doc. No. 10120964). Immigrant visa applicants who have cut-off dates that retrogress on January 1, 2011, must complete their immigrant visa processing and have their immigrant visas issued on or before December 31, 2010. DOS cannot issue an immigrant visa as of January 1, 2011, unless the applicant meets the January Visa Bulletin's newly-established cut-off dates.

The DOS Visa Office (VO) allocates blocks of visa numbers to posts for their use each month. The allocations represent applicants who have been reported as documentarily qualified and eligible for an interview during that month, based on the newly-established cut-off dates. The allocated numbers are not reserved for applicants whose cases cannot be finalized and issued during the original month of allocation/interview. At the end of the month, posts are required to return any unused numbers to VO, which are reincorporated into the pool of visa numbers available for future allocation. Applicants are always subject to the cut-off date that applies to their visa category at the time when visa issuance could occur. Therefore, if the immigrant visa cannot be approved by the end of December, applicants will need to wait until the priority date is within their established cut-off date to receive their immigrant visas.

its what we all knew, they just confirmed it officially. though they didn't say how long may it take to get retrogession over to previous schedule. but my questions is - what will happened to the payment we have already made for the aos & applicant visa fee? if the retrogession will not be over in next one or two years then will we have to pay the fee again? is there any particular time given by nvc for the payment to be valid unless the case is completed within this time?

I would suspect they will simply put case on hold and when numbers are available they will proceed, the fees have been already paid.

According NVC invoice, its only good for 1 year. So i guess we have to pay again or we may request for fee waiver :star:

Just means they ran out of numbers for 2010, there will be more next year.

Let me correct you, According AILA information, DOS(computer) assigned the visa number to case file, They will recover those number by selecting current PD status, like while your inteview schedule for the month if you are not current PD that month, they will use your visa number to the current PD cases of that month.

But, good thing is may be it will open ups by July/August-2011.

yes deshi brothers,

we cannot expect a better movement before October 2011, when another Visa Year begin. As the visa bulletin is moving slow, there will again be less demand, as fewer number of petioners will apply like before, i hope they clear 2008 and 2009 by October 2011

This is definitely very shocking for me and my wife. It was only last week, that we have found out about the HUGE Retrogression come January 2011. I never thought that Priority Date will be an issue for us nor that we will have to monitor them since our PD is March 2010 which will only be current until December of this year - never really thought that a retrogression will happen in this category (F2A).

How can there be a huge retrogression if its them who set the progression of the PDs for the year 2010. We all have seen how fast it went but now, it is just ridiculous that after setting our hopes up that soon our families will be united, it will just then be shut off and nothing we can do about it but to WAIT.

I have been wanting to post that since I knew about this retrogression. Yes - we will have to wait.

I have been wanting to post that since I knew about this retrogression. Yes - we will have to wait.

My situation is - AOS and DS-230 is yet to be submitted. All the fees has been paid already. And for that, for sure I will be affected for sure by the retrogression. Has this ever happened before? In the history of NVC - DOS, has this ever happened that huge progression of visa numbers for a certain period would be followed by years of retrogression?

Yes it has happened in the past.. it's definately not uncommon

It happened only for 1 year, not 2 years and 7 months. This is too much. It is clear that DOS/US GOVERNMENT NEEDS MONEY.

Can't help but believe this... While that by mid of November 2010, DOS/NVC is already aware of the retrogression by December 2010 (upcoming Visa Bulletin). Nevertheless, we still received a billing dated Nov 24 as part of the CHECKLIST Letter.... We had it settled on Nov 24 and was tagged as PAID by Nov 30. Shouldn't they stop collecting IV Fee already by that time?

you don't know how fast the PD dates will move... if you look at the Jan 2010 bulletin it indicated Jan 06 for F2a... this moved very quickly to Aug 2010 by the end of the year before retrogressing... the same or similar thing may happen this year... just have to wait for the Feb bulletin to see how things are progressing

well we all knew that PD might get forward one more time at the end this year. Think about PD for all 2010!!! a-ha....

Lets say someone PD from January 2010, H/her case completed by NVC last month...and retain at NVC for visa number available according to January visa bulletin. Now one more time for PD get forwared after May/2011...His/her visa number available...now NVC will not issue any interview date until updated the new AOS...Another month killing to process from reopen the case to AOS and completed..by this time if visa number get retrossed again.So he/she get sc**red again...This is insane. Why NVC needs to process 2010 cases which will not current for PD next couple year..5 grades students can predict this according to previouse visa statistic........What we have wrong done to State department that we're getting this punishment for? We are only innocent immigrant and came to united state for living american dream... If State department needs money..just tell us that they're just collecting advance money from Applicant but visa number will not be issue further reason.... We just want honest and legitimate words from State Department.

Pls note that According Visa Statistic F2A PD 2007 hasnt finish yet. How come they have forwarded the PD to 2010/Aug....
