Info received today from DOS re: K1 returns

Hi everyone, I wanted to share info I received from the department of state today.

Our K1 was denied on Oct 20. I was informed the case was returned via diplomatic pouch on 10-22. I have not been able to "track" the diplomatic pouch. When I call the number and ask for the where abouts the man there tells me there is no pouch with that number in the system. So today I call dept of state and "sara" there tells me that they do not have our case yet. She had the same diplomatic pouch number I have. I asked her why it cannot be tracked and according to her, it can take 8-12 weeks for the pouch to arrive. It has been 8 weeks for ours. She also told me that immigration WOULD NOT be reviewing our case. She said immigration is NO LONGER reviewing K1 files that are returned. WWWWHHHHHHAAAATTTTT!!!!!!???????So, no more NOID for K1? She said only reviewing marriage visas that are returned. Has any one else been given this info? Would love to hear what you all think.

It took about 3 months for our first k1 to return and was never reviewed (that was 2006). Some cases have been reviewed but it's not common to get a NOID. Recently Alwaysandforever(Monica where are you?) received a NOID and it's on its way back to Casa. Perhaps Monica will chime in here.

This is actually something I have expereince in. Before I got married to my wonderful Egyptain Husband, I was with a Moroccan man. We too was denied in Oct of 2009. The pouch does not even leave Morocco for a month or 2. And it generaly takes 3 to 4 monthd before NVC recieves it. And then takes a month for USCIS to recieve that. Now, they use to review the K-1's but don't seem to now. My lawyer wsa shocked that they did not review it. It use to take 18 months once USCIS had the file to review it and denie it or request more info. But with-in the month of recievig it they denied it. And I had another friend and her's was denied after recieving it.

The best thing about K-1 is you can refile a year after your NOA1 date. But you really need to talk to a lawyer to see if you can get idea's of why they denied you at the consulate, because refiling will be a 50/50 again and if there denied a second time... that is not good for your future. So another trip is most likly in order again, and a serious free consulatation is in order. My lawyer could not figure out why we was denied we was the same age and all, and our red flags were low. But we were guessing his english was not that well and he got hung up on there trick questions. I hope this helps.
