I-129F to be filed overseas (Interview? Mailing address?)

Timeline

I am living in Romania indefinetely (with my Fiance and her 14 year old son) until we complete the visa process, for all of us to move to the U.S. and be married. We are getting close to filing our 129F form, but need some more information before we do so.

1). As I understand there is usually an interview with USCIS when a 129F form is filed. Will I have to fly back to the U.S. for an interview? If so, what office will the interview take place and how much notice will I get before I have to be on a plane (since last minute flights are so expensive)?

2). Since I have a foreign address, how will USCIS contact me for any correspondence? If I request them to to use my parents as contacts, which is where we will be living for short term after we move to the U.S., will they. My concerns are: USCIS not being able to contact me here in Romania (I do not trust their postal system here), or USCIS may not even contact people with a foreign address and phone number listed on the 129F form.

Any other tips, advice, or information would be greatly appreciated.

If it makes any difference, I am a born U.S. citizen, and I am filing at the USCIS office in Nebraska. I lived in Oregon before moving to Romania, and we are going to live in Illinois when we are able to move to the U.S.

4-12-2006 I-129F NOA1 :

6-1-2006 Touched sort of...... sent to CSC (California Service Center) like many others

6-14-2006 CSC emailed me a notice of receipt of my 129f (transfered from NSC)

6-17-2006 Touched

7-3-2006 IMBRA RFE received at home

7-5-2006 Mailed IMBRA RFE back, Also my file was touched for the first time since 6-17

7-13-2006 Received email that IMBRA RFE was received by CSC

7-14-2006 Touched

8-10-2006 I-129F NOA2 APPROVED !!! (no touches before approval, as many have spoke of)

9-08-2006 NVC case approved:

: I started calling the NVC automated line about 2 weeks after NOA2. They never had any information for me or acknoledged that they received our case, so I sent an email to the NVC on 9-01-2006. On 9-08-2006 I received a reply to that email saying that our case was processed and forwarded to the US Embassy (Romania) on 8-31-2006. They also included the case number in the reply to my email inquiry. I guess I would have not been notified by the NVC..... very strange.

9-6-2006 Romanian Embassy received our K1 paperwork.

9-11-2006 Received packet 3 in the mail

10-11-2006 Set appointment for interview by calling the Romanian Embassy !!! ONLY SET AN APPOINTMENT AFTER HAVE ALL DOCMUMENTS ARE COMPLETE !!!

10-18-06 Visa interview - Visa granted :)

11-7-06 Welcome to America

Look into a process called DCF (Direct Consular Filing) and find out if Romania is one of the countries that allows it. Instead of sending the paperwork into the US, you can file it directly with the Consulate where you are living.

NO. You send in the paperwork and wait for the NOA1 and NOA2 and then letter from NVC.

The interview concerns your fiancee. She will be interviewed at the consulate in Romania.

After you send your I-129F petition to USCIS, you can receive their responses at your parents address. Eventually the consulate will receive the appropriate documents from the NVC and your fiancee will be sent a few more docs to fill out and return. Then she will have to go through a medical and finally an interview. After she successfully gets through the interview, and has her visa, you can both come over here.

Contrary to what kajikit says, DCF is not an option for you. That only works if you are already married. There is no way to file DCF for a fiancee visa.

Your situation is somewhat similar to ours when we filed. Rob used his US home address as his permanent residence when we filled out all the K1 documents, even though his pay slips etc contained his Irish address. This was perfectly acceptable, as the US is legally his permanent residence.

This was where USCIS sent all the mail, which was then forwarded to us by his family, at our Irish address. I think you actually HAVE to use a US address or the petition is not considered, but I'm not 100% sure about that to be honest.

The interview is for the non-USC and takes place in the US Consulate of their country.

1) There is no interview associated with an I-129f petition. I think it would be very unusual for the USCIS to call you in, if there are any questions they normally send an RFE.

2) Good question. And perhaps a good reason to have an immigration attorney in the USA who can receive and handle any USCIS correspondance for you.

If you are legally resident in Romania, you really should investigate getting married there and filing I-130 at the Consulate. May as well get it all done at once, yes?

I'm currently in the same situation as you....I'm living in Brazil with my fiance and have filed for the K-1. If you decide to go the k-1 route (versus the DCF, if it's possible there?) then you have some options. If you want to file using your address in Romania, it's acceptable, but you need to mail your packet to the USCIS office where you last lived in the U.S. I chose to use my parent's address in the U.S. and had them keep me updated when they received paperwork from the USCIS. As far as your end goes, you can prepare everything in Romania, mail your documents to the U.S., and stay there in Romania. You will not have to leave the country to return to the U.S.
