Hi to all,

Hi to all I am from the Philippines and I have a pending petition filed by my wife. Its in the NVC now as my priority date already became current. Theres a strange thing that happened with the payment. My wife used a money order through USPS to pay the AOS and IV fee. Her lawyer send it together in the same envelope. Unfortunately, when she checked the status of the payment the IV fee appeared to be not paid while for the AOS status was shown as paid. Its so strange as to how it happened. I know that this problem alone will take a lot of time for it to be resolved. My wifes lawyer advised her to request for the tracking information of USPS which will take 3 weeks. The lawyer said this will be presented to NVC to show that the payment was indeed received by their office. I feel that the petition is in limbo and not moving. I just want to share this with you and I hope somehow ya'll help me have hope in it.

I would also like to know if there is a chance that I can be approved of a tourist visa considering I have a pending petition case. Thank you so much and Merry Christmas to all!

Chances of obtaining a tourist visa, with an immigrant visa pending are really slim to none. I wouldn't waste the visa application fee on that. I'm curious though, why does your wife or lawyer not have a copy of the or the certified mail receipt...that has a tracking number which displays a tracking history on the usps website if you type that number in? Or why wasn't there a return receipt requested...this would have returned that little green card signed by someone at NVC, showing the received your mailing? If the lawyer mailed these documents he/she should have known to use this form of mailing...to have some documentation that the mailing was done....an even with a money order, the lawyer or your wife (or both) should have made a copy of it before mailing off the original.

Thank you for your response. Unfortunately, my wife wasnt able to request for a return receipt. I dont know why the lawyer doesnt know anything about this. He should know better. I admit there were some lapses in the process and we're paying for it. I just hope there is still some way to correct this error to be able to get back on track.

If the AOS fee shows as paid, then the envelope both money orders were in, arrived. No need to track anything. When you login to check the status of the IV fee, does it state "not invoiced" or "not paid". If it says "not invoiced" the payment was simply sent too soon. Whether they'll send it back or just wait until the invoice is generated to credit the payment is anybody's guess.

Facts are cheap...knowing how to use them is precious...

Also, it is best for you to stay put and wait for your pending immigration visa rather than apply for tourist visa. It will complicate it even more.

Yes its going to the same address in MO. The frustrating part is my wife called NVC again and she was told to just request USPS for the tracker to check if the money order was encashed. I dont know why she was given all these instructions wherein it was clear that somebody in their office received the package.My wife called USPS and was told that somebody received it. They actually gave her a name as to who received the package. The sad part is it will take 3 weeks for USPS to track or give us an information if the money order was encashed or not. 3 weeks is a lot of time for waiting. I'm frustrated because the case is not moving forward to think it was not our fault that they didnt received the payment. I dont know if it really happens in NVC. I cant believe how other people decides somebody's fate by their carelessness. Why do we need to suffer these consequences wherein it was clear that we did our part.

If you have to pay it again, I suggest you pay it online at the NVC via a checking account. That is the fastest and safest way to do it. I paid online and it quickly cleared my checking account and within a few days it appeared as paid.

You should never rely on the USPS when sending money orders or anything important.
