Dear Members

Someone plz guide me as we are waiting for our interview call in F-4 category my brother is US citizen petitioner. My husband wants to join later I want to know that . can we use follow to join benefits for him after reaching US. And as I have no assets, is it possible that my brother US citizen or sister Perm resident can sponsor him on my petition for follow to join.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thanks, actually we dont know exactly and we are figuring out if we get late by more than 6 months than what are the other option, so i want to know about follow to join procedure.And on thing more about this 6months period, Is there any such adjustment possible that I only provide passport at interview, and he provides later then before six months i move to usa and he got his visa after , such that he gets time more than six month

There is no "follow to join" as such for spouses, that is for kids.

As far as I am aware, because your husband is only getting a visa through you, it either has to be issues at the same time as yours. If you already know 6 months will be tight, you could delay the interview- also be aware that there may well be AP after the interview delaying visa issuance for all of you. Another option might be for him to come to the USA at the same time as you, then depart again. If he cannot join you, you would need to petition him afresh with an I-130 of your own.

Thanks for your help, I dont know how do u say that no FTJ for spouses or rules are changed but following is available on USCIS web site

Following-to-Join Benefits

This section is for beneficiaries who became permanent residents through a preference classification.

If you were married and/or had children who did not obtain permanent residence at the same time you did, they may be eligible for follow-to-join benefits. This means that you do not have to submit a separate Form I-130 for your spouse and/or children. In addition, your spouse and/or children will not have to wait any extra time for a visa number to become available. In this case, you may simply notify a U.S. consulate that you are a permanent resident so that your spouse and/or children can apply for an immigrant visa.

Your spouse and/or children may be eligible for following-to-join benefits if:

The relationship existed at the time you became a permanent resident and still exists, AND

You received an immigrant visa or adjusted status in a preference category.
