Have hovered around this forum and have to say it is quite informative and hopefully I have picked up some of the lingo... Also hope this is ok here as I couldnt see anything close to the VWP question about to ask....soo here goes.

I have been to the usa 3 times this year for a 1 week 2week and another 1 week stay all in the jan to june period, we got engaged at the back end of the june visit and thought we would pursue the 129/k1 method, but since then we have "U" turned and wish to marry at christmas, being from the UK and allowed to use the VWP, we have read it is ok to enter , marry and leave, but bring sufficient proof of ties to the UK, which is not a problem as I am divorced with 50% stake in a house , bank holds the deeds and in the process of being bought out, but will take a few months yet, no lawyers involved and live on my own with a flat and lease just renewed, have a good steady job, own my own car and have savings in the bank...also I am commited to a contract for my internet until may next year as well as paying off an old credit card bill.

The question is and I have seen on the US embassy website that you may enter on b1/2 or vwp if eligable provided your intent is to return and can prove residence, which I can and have a letter from my lanlord also.

Ok thats the background info, my concerns are do I say straight out that my reason for visit is to marry my fiance and that I intend to return home at the end of the 2 weeks visit in the hope he sends me to secondary or asks for proof of ties.

I am an honest person and people can usually tell from my face that I am hiding something and I see it like this, from previous visits where i have already declared my reason for visit is to see my girlfreind and have always been asked for return ticket and how much cash I have on me, but see this going down totally different in the way of questioning and feel that my last visit will have been noted as visit to see girlfriend and thus their questions will be geared towards that fact, but now she is my fiance which is a totally different status in the eyes of the US officials.

I am not asking or looking to circumvent the rules/laws I want to do this right and not impede future plans so seeing the questions go like this;

IO=nature/purpose of visit?

slef= pleasure!

IO= length of stay?

self= 2 weeks and 1 day!

IO= where are you going........As I am hopoing to clear immigration in dublin

self= Tell them the state i intend to visit!

IO= do you know someone there?

self=Yes!

IO=who?

self= my fiance!

IO= will you be marrying her on this trip?

self=yes!

Now, trying not to second guess these people, but thats how I see it going so either way they will find out my intent to marry and return home, but its whether they decide to believe that

Do many people declare they are getting married under vwp? do they encounter any problems when trying to prove their ties back home?

I know it has a lot to do with IO on the day and how they feel, but comments are greatly appreciated.

Getting married under the WVP and leaving is perfectly legal. If asked if you intend to marry, reply 'yes' and then state on X date you plan to return to the UK due to ___________ and produce the ties you mentioned. Do not even give them an opportunity to question your motives.

Otherwise tell the truth, be confident in your answers and you'll be fine

There's lying, which is never ok. And then there's answering questions honestly with only the information requested.

If you're planning on bringing your tux, wedding rings and details of your honeymoon suite reservation in your luggage, then you'll want to declare you intentions at the POE.

I personally would say, 'I'm traveling to spend time with my fiancee and family over Christmas. We have plans to get married on xx date and will file our petition for a CR-1 visa before I leave on xx date, returning to England to finalise all my business there. I have here ...' and then hand over your return trip information and anything you can take with you that shows your ties to Blighty.

This should include at least:

Letter detailing your arrangement with the bank regarding the house

Copy of your lease with the minimum term of 6 months highlighted

Letter from your landlord/ agent stating you have been a tenant since xx date, you have recently renewed your lease and you are liable for rent on said property until xx date.

Letter from your employer stating that they know you're am on leave from work to spend Christmas and get married in the US, that you have not given notice and they are expecting you back on xx date.

Logbook showing your name as owner for the car

Take the internet contract with, but if I were an IO I wouldn't be too impressed by that. Nor credit cards. I still owe £4000 on mine, and am just re-paying from my English bank account by D/Debit.

If they ask what you'll do if they refuse you entry, say 'I'd go home and we'd file a petition for a K-1 instead.'

Just remember, you want to demonstrate that you know what the rules are and you're planning on following them, instead of renegading it. Maybe even complete as much of the CR-1 paperwork as you can and take it with you.

*shrugs* But that's just me... lol. Will be interesting to see what others suggest.

Intresting to read please keep them coming! Has anyone read of many under my or similar circumstances being denied entry, again I know it depends on the IO, but wonder what casued the IO to react awfiftly in denial?

Most of the CR1 is completed as only copies are needed at this stage all we have to do to complete it is passport photos one each, marriage cert copy and was told not to take any documents that could be mistook as potential to attempt an AOS in the way of completing the packet for the I-130.

Would never dream of taking credit card statement, they would deny straight away...lol

Well, if there was a magic 8 ball out there that would tell you for SURE you would be allowed entry... it would be worth more than its weight in gold. It certainly is up to the person you talk to at your POE.

The stuff that you have certainly proves ties, and you plead a strong case. Ultimately though, if the person is mean, feels harrassed, or has a general disregard for basic human happiness they can send you packing.

As far as answering questions.. answer what they ask confidently and in as few words as possible. Dont get squirrelly and nervous, and NEVER TELL LIES!! :)

There is no guarentee, but with loads of evidence of ties to your home country, and clearly stating that you understand the process you are about to undertake, there should be no real reason to deny your entry.

I understand this totally, but equally I feel that if the IO has to work hard at getting this far he is either gonna get fed up in trying which i dont think is in their nature....or.....they will think that is more and need for further investigation and possibly hiding something....just my opinion, but thats based on that exact conversation you noted
