Good day to all- I would like to ask an advice regarding my sister. My sister and her USC husband has been married for almost 4 years now (4 years next year on april). My sister has never been to US nor had been issued any type of visa. The USC husband once filed a petition for her last november of this year but it has been rejected due to the reason of incorrect information of Part C of I-130. So the entire package was sent back to him. Until now he did not re-send it again.

Now, me and my husband decided that we will be the one to re-send back the I-130 and pay all the fees needed to be paid as a gift for them. My sister had already talked about this matter to her USC husband and he agreed. The USC husband would only sign the documents needed to be signed. My questions are:

1. Is this possible that we can file in behalf of them, since we will be using the personal cheque in the name of my husband?

2. If this is possible, is it ok too to change the address, so the notices that the USCIS will send, will be directly send to us?

Her husband must be the petitioner, if you wish to pay the fees as a gift then that would be ok. However if you try to run the process for them it will look like a fake marriage for immigration reasons. Her husband can provide the case number to you and you can track it online. That way you know when he will be getting anything that needs action . Good luck

This will not be over quickly. You will not enjoy this.

Agent fill out the forms, your signature as person preparing the form(s) will be required, along with the petitioners. As acting agent you can receive all correspondence from USCIS NVC USEM After reading your comments about the petitioner and time span of marriage, last filing exc., I don’t recommend that you use your personal check this may look like your the one who is trying to obtain the visa. Remember the petitioner is the one who will need to meet all requirements! Including finical support not to say you can’t be a joint/co-sponsor.

Give him the money and have him sign the check or send a money order.

EDIT That is if you meet the requirements and the finical requirements.
