Hello there! thanks for the info's

Do you think its not too late to ask for an expedite on our case? Our case was almost 2 months on NVC and we just got an RFE last week and they said it will be 20days after and they will send us a notice, hopefully not an RFE again, I was a bit worried and frustrated this time my husband will have a second surgery on his shoulder probably this febuary. I was hoping to be with him before his second surgery. Do you think they will approve it when we request for an expedite for our case?

Any comments or suggestion is appreciated. Thank you =)

If you properly responded to the RFE and otherwise qualify, I would expect the USCIS approval within two weeks of receiving your RFE. It might take a little longer with the holidays. Your husband could then request an expedite through the NVC stage.

When I called in the expedite request I had to explain to the operator why there was a need. She wrote down what I said word-for-word and said that this was they would use this evidence to decide whether or not to expedite. Maybe you can draft a response that you will read in advance because I know I forgot to say one or two things. Afterwards, she said that I would get a response within a week. If USCIS has your email that is how they will communicate with you because its faster and easier for them. Check that your spam blockers are not on! I got my response in four days, though there was a weekend btwn when I called and the response.

You can contact your US Senator and ask if you had a emergency

and a doctor letter stating A DIRED NEED LETTER, to have your

USCIS case expedited and a matter of USCIS law states an expedite

can occur if there is a hardship fincially or medically within the

family. The US Senator can assign a caseworker a file number to help

you contact the USCIS with them.

Contact your US Senator and ask if they can assist you with your issues.

Call direct or e mail them at the website under Immigrations or Senators

e mail contact e mail address.

Correct to an extent, but not a pre-requisite. Its not vital to get in contact with your senator. From start to finish we havent had to use a lawyer ( did seek senator's liasion help but she did nothing). And ours wasnt a straight forward case at all. There were certain issues that needed to be addressed. All stages except the waiver were expedited by ourselves. The waiver stage was expedited by myself with the backing of the US Ambassador in london.

Dont rely on your senator coming through for you, you can try, and its great if they do. But you can request an expedite by yourself, of course and it is completely do-able providing you have supporting documentation.

After all, the USCIS has a duty of care to a certain extent to its citizens.
