hi ...new to this forum and it has been a massive help

we filed late sept 2010...biometrics nov 4...received EAD and AP but no interview notice as yet...my hubby is pending AOS from a b2 visa which expired nov 5 2010 though his I-94 is valid through feb 2011...he received his AP last week and is scheduling a 10 day trip for early jan 2011...btw 4 and 13th jan..i wonder if he is eligible to do this and if there are any chances he could be refused entry upon returning on jan 13 on account of his recently expired b2, esp since immigratn frowns upon AOS from a b2..your input would be much appreciated

This should have NO problems, this is what the AP is for, he has no overstay longer than 6 months that would bar re-entry.
