melbar,

I am sorry again to hear this and very sorry for your Wife as I am sure that she was hoping that you would be traveling very soon to the USA to be a Family and I know it will happen BUT that does not make the situation any easier for either of you. However, I hope that the time that the two of you had while she was here, was enjoyable in-spite of what happened! If you do not mind, can you please tell us exactly what happened from start to finish during your interview? How long did they interview you for, how long after you arrived did they call your name? Did they look at any of the evidences at all? What did they ask you two? Also, if you have your wife call the DoS at the number that I gave you on the other post and have her ask for a "visa specialist" and no one else.... than this will help! Sometimes you have to very adamant about these types of things....and like I said in the previous post "IT IS YOUR RIGHT AND THE RIGHT OF YOUR WIFE.... THE US CITIZEN" I am sure that this process will be over in no time and all will behind you!:D

WOW,:wow:

Sounds Like a LONG day and kinda stressful, how did your Wife handle it? So you were there early.. ours is at 8:30 am as well! Was the Lady that interviewed you nice and was she Turkish or American? Did they have you sign anything? It sounds like you have some great evidence and they are reviewing it. Did the Lady say AP? I do believe that you will be hearing some good news soon and the wait seems like it will never end BUT it is all worth it! I bet you and your wife will "burn" that website that they told you to check for your case number.... and speaking of case number , is it the same as the case number that you were given in the beginning (you know the one where it showed your appointment date? Stay busy and I hope that your Wife had a com-fie flight back to L.A. and I wish you and her all the best!

Merhaba Melbar (Baris),

This looks like a Stokes Interview from what you describe. I'm so sorry to you both for this. Don't give up, they will review and by the Grace of God, you're going to get this Visa. It might be delayed.

melbar,

Mari is right, you will get the visa, just hold on and keep faith. I do not believe that this was a stokes interview... usually couples that are actually living together are given these, the questions that were asked during you and your Wife's interview were of the norm.... If a stokes interview was given it would have been MUCH more in depth. Here is a link that shows some examples of questions that are asked during such an interview.

Kelly you could be right and typically, for Stokes don't they put them each in separate rooms? Or, is that just certain consulates? I'm thinking Baris had too much secondary evidence (which would work to prove relationship for a K1 Fiance Visa, and only after there was solid proof for meeting). But not strong enough evidence for a MARRIED COUPLE as primary evidence; it would certainly only support the primary documents which appears there just simply wasn't enough from what he describes. *See my reply to Melbar*

thank u so much everybody here thank u.i hope i get visa soon. thank u so much for help

Baris,

I've been thinking about your case and may I suggest to you and Melek, that you both get prepared in case the Embassy asks you for the following PRIMARY EVIDENCE? You must prove to them you are a married couple, not a "fiance couple waiting to get married". Everything must be in black and white, solid without question or doubt. They want to see proof like Kelly & Fatih submitted, which if you have questions of what she submitted ask her! She threw in the kitchen sink too! Seriously, 2000 pages of BS is not what they were looking for with a married couple.

I know the emotions have been running high here and there are a lot of tears going on (believe me when I tell you this AmeriTurk family felt for you two). But it's time now to pick yourselves up and get a move on for what they will either ask for, or are looking for, and I want you to be ready in case they do.

Here's a few things to start working on: EVERYTHING IN BOTH NAMES!!!

  1. Lease or Rental, Mortgage of home in Both names
  2. Car note in both names
  3. Bank accounts in both names (both checking and savings) --- Get the printed checks with both names on it and void it out, to submit for evidence.
  4. Save the Date Wedding Invite or Reception that "will take place in the USA".... Who says you can't also have a celebration / reception for her friends and family here??? You can have her order this on Vistaprint online too.
  5. Pictures (of course you already had these but include again)
  6. Pictures of wedding in Turkey.
  7. Insurance Premiums (healthcare & Life)
  8. Credit Card Statements in Both names
  9. Retirement plans stating who is beneficary (that would be you since she is adding you to her plan).
  10. New pictures with your family (from this last visit perhaps) that were not included at all. AND YOU DO NOT NEED 5 KILOS OF THEM EITHER. Simplify and put maybe 10-20 most significant and important ones.

I am sure that Kelly can help you more as this is more her arena than it is mine. Also, she understands the Turk side of things and maybe there might be further PRIMARY evidence you can get from Turkey too. Stop with the secondary evidence now, they've seen enough! And as I said before, they're not interested in reading 2000 pages of love chats. They couldn't care less as it doesn't prove a marriage but only that you two communicate. Big deal. Remember that only supports your primary evidence, but it is NOT enough for them. They want solid information that states this marriage is not a sham.

Your wife is a RN. She should know what it takes in "med-legal" terms when it comes to keeping patient records for proof and history. Tell her to think in this capacity as well for primary evidence.

OK Baris, pull it together now ... we got to get you ready for ............A M E R I C A!! lol...

Morning Mari,

Yes, when a couple is "lucky" enough to have a Stokes Interview, they are interviewed separately and is from my understanding very grueling and personal at times and is usually a lengthy one as well!

From what I understand and from what I have read here on VJ, Primary Evidence of the bona-fide marriage is the Original marriage certificate between the petitioner and the beneficiary issued from the official agency of the country

Secondary Evidences of the bona-fide marriage is as follows:

1) Documentation showing joint ownership or property

2) Lease showing joint tenancy of a common residence

3) Documentation showing co-mingling of financial resources

4) Birth certificate(s) of child(ren) born to the petitioner and the beneficiary

5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship

6) Any other relevant documentation to establish that there is an ongoing marital union

1) All the trips of the petitioner and/or the beneficiary to meet each other - like passport stamps

2) Auto Insurance Policy under both the Petitioner and the Beneficiary names

3) Health Insurance Policy under both the Petitioner and the Beneficiary names

4) Life Insurance Policy under both the Petitioner and the Beneficiary names

5) Will prepared by the petitioner and/or the beneficiary

6) If marriage happened in prior year, income tax filing together

7) Pictures together - Before marriage, Wedding Album, pictures taken in every occasion

8) Marriage documentation in the religious ceremony such as from church, mosque, temple etc.

9) Phone logs

10) Chat logs

11) Emails

12) Greeting cards, Marriage invitation cards etc.

13) Hotel receipts, Rental car receipts, Gift receipts or any other miscellaneous receipts of the expenses incurred between the petitioner and the beneficiary

14) Money transfer documentation that includes spousal support

Some items may not be applicable to everyone!

Here are some additional things that can be used as well:

any joint clubs together like ,Sams Club, Cosco , AAA auto club or a fitness center

Because Baris and his wife are not living together, it is a little more difficult as they don't have as many options as say a couple that do live together BUT there are some things that can be used and of course the consulate should take this into consideration as I am sure that they do!:whistle:His Wife visited him several times and that I would think should count for something!

HANG IN THERE MELEK and BARIS! B-)

LOL... well I wouldn't want anyone in this AmeriTurk forum to get "that lucky" and sit in two different rooms. Nahhhhhh ----- Uhhhhhhh!!

OK, I can't see a married couple baby's birth certificate as secondary evidence. Then again, I guess it just means they can breed. While the marriage certificate is the primary evidence for a 130 petition, then why wasn't Baris and Melek's accepted as such?! That can't be the only evidence that is primary, yet it ist the MAIN PROOF of a bonafide marriage. Yet, I guess to the Embassy, it wasn't enough?! It frustrates me to see this go into AP. Sans those 2000 pages of tedious readings (fone logs, chat logs, love letters, etc), evidently that wasn't enough either. But if you read any one of the other countries Embassy's the CO's are not interested in this kind of reading material; they only want the brass tacks. Quite frankly, they just don't have the time, which is what this CO told them in the end. I'm hoping that CO was just tired and hungry at the end of the work day and wanted to get home!! That being said, when she was well fed and rested she'd come back the next day, review their file and APPROVE THEM!!! Yeah!!!

Kelly what you and Fatih sent in seemed more than reasonable proof beyond a doubt! Yours has no wiggle room at all. Your list was extensive and even if Baris and wife lived together, or not, they still would have thought to accumulate actuals of, at the very least, joint bank accounts (HERE IN THE US as soon as they married and upon wife's return --- did she open one because they're married now and they would need to exchange monies at some point via ATM Card or Bank Transfers while apart?) So what can Melek do to remedy this now that she is back in the States from this side?

Do add both names on documents as you have listed above, right? IF not already done and completed, then Add Baris to Accounts, (bank, life insurance, health coverage, etc). She can also get the affidavits, and so can he, from friends and family. She can get that Costco or Sams Club where she lives and that's easy to get 2 cards -- one each, one account! I think Baris talked about receipts of Money Transfers between them already, and I think that's good evidence for a married couple. Definitely her Passport Stamps, boarding passes. Since the CO was so concerned about their wedding, and the honeymoon? I'd seriously consider a Marriage Celebration/ Reception upon his arrival, and have those "save the date" invites printed!!! I found it odd that the CO was all over that btw... Esp, when they could produce wedding fotos and that marriage certificate according to what Baris wrote.

Kelly, what can Baris do from that side that would set a stronger foundation for evidence that Melek cannot do from this side? Can you make any suggestions for them?

Thanks,

Mari

melbar,

DID all Turkish Men get the dreaded "green slip"?????? You say that the Iranian MEN did not, please if you could explain this as what I have read 99% of Iranians get put into AP, Perhaps they were already in AP and had come back after everything was cleared and are ready to get their visa.... this is what I have read on the website for ANKARA.... but who knows.....

I don not think you will need to have another interview and it is a good thing that you and your Wife have called the DOS and the Embassy, if nothing more and if you are like I am, simply hearing what they have to say would give me peace of mind and then.... of course... me being me.... would call them again, but that is just me!

Apologies if I state in a comment that my husband and I have been together for years & years. It's just that I can hardly remember a time when he and I were not together.

hi mari we already have them (bank, life insurance, health coverage, etc) and they did not ask about western union tranfers cuz the lady stoped us it was alot she was hurry ..while i was giving the hotel reservations she asked what is this i said hotels reservations she dont need for that...and she even did not ask for plane tickets cuz she was with we were stayin at hotel they could see us over cuz they have cameras and could listen what we are talking...before interview day we went to walk around embassy i showed the embassy to my wife ... of course they know it is importand thing whenever she goes to other country they could see it in monitor screens ..... this is usa they can see anything ofcourse they know our marrige is real but they dont want to give visa rigtaway......it doesnt matter if they wont give visa to me i will bring my wife to turkey... its ups to them to visa or no...i wont leave my wife cuz of this they can not judge my love or say anything to my marrige i love my wife so much a nd i will love her forever nomatterwhat

If you have all the documents like you stated above, then I believe that is enough. There really isn't anything that he can get here in Turkey that can help them, maybe if she was here it would be different as she would be a "resident" per say. In my opinion, they know that your Marriage is real BUT they have to take the extra steps and that is what they are doing unfortunately and that takes time

I feel as if you are over the Biggest part (interview) and now you just play the waiting game!
