What to do?

We applied for our K1 in September. We have a wedding planned on May 1st. We are waiting for NOA2 having received NOA1 on 13th September. Radio silence since.

Will May 1st happen or do we need to cancel?

If I were you I would cancel and wait until you get your NOA2. Once you get that you can better gage everything....Just my opinion Good Luck

It very much depends on September filers getting approved on on before the 5 month mark. If they start adjudicating these petitions in any great numbers then a backlog will start building at the London Embassy. So in short i wouldn't like to say whether or not you will make your wedding date, but as things are it is looking tight. NVC to london interview and passport with visa in hand takes between 2-3 months

I n your opinion, if you had to pick a date, by which point one would know it definitely isn't going to happen in time, when do you think that would be?

I n your opinion, if you had to pick a date, by which point one would know it definitely isn't going to happen in time, when do you think that would be?

NEVER make any plans which depend on the uncertainty of getting the visa! So many things could delay the process, could go wrong, etc. Even if you are not denied you could be put in Administrative Processing, they might mispell the name on the visa, the service courier could take forever to deliver, etc.

As of late, both service centers have been hitting the 5 month mark (and even longer) to adjudicate petitions. I do not know whether the consulate in London schedules interviews fairly fast or not after receiving the petition, but again, it would be risking it. So many things can go wrong!

You are going to have to think long and hard about this one. If I were you, I would definitely cancel. Actually, I have made no plans whatsoever (even as it is annoying that EVERYONE asks me routinely, "when is the wedding?"). You just cannot make plans with the uncertainty of this process!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Actually, Dan's post was THE MOST helpful for two major reasons. One, others will read this later and learn from your mistakes. Second, you now can face the fact ONCE that you made this mistake, cancel the wedding plans, then make no more plans that require non-refundable deposits until the visa is in hand. This inconvenience is part of the territory when planning to marry a foreigner after obtaining a K1 visa. Join the club. Every other member here either went through it with a fiancee or spouse.

Facts are cheap...knowing how to use them is precious...

Actually a very helpful post. The OP should cancel and understand what they mean by the statement "Never make any plans or buy the plane ticket until the visa in the hand."

Three thumbs up to pushbrk, as usual, and to Dan for being the first to post the correct advice. The visa path can run the gamut between (at one end) quick, smooth approval & interview to (at the other end) administrative processing, a 221g at the consulate, or outright refusal of the visa.

Just as one example: Even if you think that your beneficiary will be interviewed at an "easier" consulate where visas are seemingly handed out like candy (and no VJ Embassy Review indicates any actual or potential problem), consular personnel can be rotated out and new people brought in, with far different standards and policies -- NONE of which you'll have any clue about until you're blindsided. Make no plans whatsoever until the visa is granted and it's in hand.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yep, K-1 here, NO plans until after we had visa in hand. Especially in our case, the consulate we dealt with LOVES to hand out denials for the NON-Bonafide Relationship excuse.

Hi.

I am afraid what the others have said is accurate, and to the point. My fiancee and I have made no plans beyond getting packet 3 ready.

This process is far too unpredicatable to make any plans, but hindsight is a wonderful thing.

Know that you are not the first and are sure not to be the last.

As pushbrk stated, others will learn from your mistake. And that is the whole point of this forum.

What you do now is yours and your fiancee's choice.

couldnt agree more with dan,even in packet 3 instruction they always print it with bold font,DO NOT MAKE ANY ARRANGEMENTS.

its alright,youll learn it in the long run and dealing with USCIS,NVC and pretty much the immigration system
