Hi Everyone,

So My K-1 was approved and the wedding is on Jan 8th, earlier this month my brother applied for an enhanced drivers license so that he can attend my wedding. He is Canadian and the wedding is in Buffalo NY. Well his past is less than perfect (as in when he was younger he has had some trouble with the law)...not sure the details pretty sure most of it was petty I don't think any of the charges or crimes were considered felonies etc. (Sorry I can't be more detailed as I don't know) Anyways they denied his petition for the enhanced license.

Is there any type of 3 day pass type thing that I (or my US Citizen fiance) could sponsor him to come to the US soley to come to the wedding???? I'm pretty sure there is nothing we can do but I'm desperate as its my brother and I love him and I would hate him not being at my wedding.

Is there any point in him trying to get a regular passport OR would that be denied under the same premise that the drivers license was?

he has called to ask why it was denied and he is waiting for them to call him back.....

HELP!

Once you get convicted of crimes traveling sometimes become problematic. If they denied him already the answer won't change this quickly. Also is a visa appointment even available that quickly ?

This will not be over quickly. You will not enjoy this.

he could try a passport. I know that most people (not all) Have been given a passport without any problems. I know some people who messed up as juveniles...Including myself and have gotten passports. Although I cannot exact tell why he was denied the drivers license in the first place.

I am sorry he is going through this.. I am trying to think of anyone you can call. Maybe a senator or JP of his city.

He qualifies for a passport depending in how long ago he was charged. Usually, after 10 years if it was a felony you can qualify for a passport. As far as the visa or pass to come here: the tourist visa is the only thing he could apply for. It could take weeks, and the criminal background could delay your wish to bring him here. A wedding is not considered an emergency or special circumstance thus you will not be granted an expedited case.

Good Luck

Will he qualify for non visa entry or a visa otherwise?

Yes, almost any Canadian can get a visa to come into the USA. Canadian citizen's are not considered a high risk to the United States because your poverty and income standards are quiet similar to ours here in the USA. You should have a visa application interview within a week tops. If you are a Canadian student it is very easy to come into the USA as well.

We are talking about a Canadian with a Criminal Record.
