Name changes

I'm not sure if this is the right forum for this

If my fiance wanted to change his name when he got to the US, would it cause HUGE problems? Should we wait til after AOS? Should he change it in Brazil right now? Our K1 is at CSC and not yet approved.

We wanted to do the same thing but decided to wait until the whole AOS process was done and over with. I think it probably costs more due stress to do it in the middle of the process, and have delays in security checks etc.

Has anyone done this before? What was the process? Did you go to court to get the official name change?

I would also be interested in hearing if anyone did this and how they went about it.

Considering how stringent security guidelines are (and are likely to become more in the future), i think the HUGE problems the OP is referring to is probably waittime on the visa due to security checks. They ask if you are known by a previous name on every single form you have to fill out. To change your name in the middle of the process is probably not a good idea. Even if it might be (for example) as simple as adding a new middle name.

Yeah it would be changing his last name too. I'm afraid all the forms will get changed!

If he want to take your last name, then it would be the same as a woman taking her husbands nane.... it can be changed at marriage.... just complete all the AOS forms in name you want to use and on the form where it asks for other names used put your old name... then you can get EAD in new name and then change SSN to match and if you are approved for AOS then your Greencard will have your new name on it....

If he plans to do it based on married not all states allow the husband to change his name. If the state doesn't allow it then he has to go the court order route or do it when applying for U.S. citizenship.

Oh man, we were considering BOTH taking his Portuguese family name which is currently not in his name at all! His dad changed it in Brazil. That's why we thought we couldn't probably do it during the marriage.

This sounds like too much of a mess. Maybe we'll do it when he gets citizenship.

Alex, Brazilians can only change their names, if I'm not mistaken, one year after having turned 21, that is, after having turned 21 and before turning 22. One cannot change their family names, though:

Art. 56. O interessado, no primeiro ano após ter atingido a maioridade civil, poderá, pessoalmente ou por procurador bastante, alterar o nome, desde que não prejudique os apelidos de família, averbando-se a alteração que será publicada pela imprensa. - Lei de Registros Públicos
