File a FOIA (freedom of information act) to receive files from visa withdrawel

Hallo everybody,

A few month ago I got sent back to Germany at the point of entrance at seattle airport. The reason was misinterpretation concerning drug use. Now I want to see the files and records the ve collected about me. I want to do this by filing a FOIA. At the form they ask: Identify the documents, records, or information you are seeking. Be as specific as possible.

What should I write in there, since I dont know what documents they actually have?! (Id like to have ALL collected files)

Im thankfull for any help

It sounds like you are seeking all documents pertaining to all entrances or attempted entrances into the USA...so why not put that?

I actually have another question even though i most definetaly will look out for legal advice by an attorney.

At the point of entry I had the chance to voluntary "withdraw" my visa and fly back... thats what i did.. I recently found out if i "withdraw" it, I wont even need a waiver but just another b1 visa(and probably have to answer alot of questions the next time I seek entrance to the us.) Is this information accurate? Or do u know where I can get the information if i need a waiver of dissadmissibility ?

That is correct, but it does depend on what exactly you signed / what, if anything, was written in your passport.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Im in vancouver right now so i dont know what exactly is written into my (now expired old) passport, but i will post it as soon as i found out. From memory i know that in the last page of the passport they stamped "application withdrawn 212(a)(7)(A)(i)( l )" on the actual visa theres a big red stamp stating "revoked".

The misiterpretation is a big thing, the only thing I remember that I signed was the protocol, when they asked me questions under oath. Under oath I stated that I have tried marijuana but on the online visa application(in munich) I stated otherwise.

So what exactly are my options to gain entrance to the us, just file a new visa? (Since I dont need a waiver ?!)

Well first thing, why are you so desperate to gain entrance into the US? Is there a compelling reason?

Secondly, what are your ties to Germany? These will be key for your next tourist visa application as your next one will be harder to obtain than the first one

The compelling reason is that i have been on a highschool program in the us for 1 year. Now i want to visit my friends back there. I dont have any intention to immigrate into the US Germany is my country and my home. My binding ties to germany are my familie my friends and my intention to study there.

On the visa they put on a stamp stating : revoked-sea application withdrawn pursuant to 22 CFR 41 122(h)(3)

212(a)(7)(A)(i)( l ) {port officer date}

I also filed the FOIA request letter...
