Applied for AOS...and got Rejection notice plz help...

Timeline

Hi. I Arrived here on K1 visa .Got married and applied for AOS .After 10 Days i got rejection notice which says that i have to submit it again with I-797 Notice of action(approval notice) for my 129F petition ,But the problem is some how i never got this I797 in mail. when i tried to get a copy of 1-797,they said i have to wait for a month to get it.my visa is expiring in first month of january and i want to apply before that. please advice .. what to do ?

You may apply for AOS even if your K1 visa is expired. You need to request and wait to get that copy of I-797, looks like there no way around it.

Timeline

Your visa expired the day you used it. The date you go by is the one on your I-94.

You must have a copy of the NOA2 from the I-129F in your AOS packet. That is the approval notice of your k-1 petition.

If you lost or never got that paper you will need to apply for a new one and pay the fee.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You won't have received it, it will have been sent to your then petitioning fiance/ee. How did you find out that the petition was approved and was being forwarded to the NVC?

I can understand wanting to AOS before your I-94 expires (assuming this is the date you're quoting, and not the validity of the K-1) but rest assured that you are not present illegally, as long as you got married within 90 days.

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017
