Jennifer ... sheesh.... this attorney sounds like one of the legals I know personally who does Immigration law. I told her about VJ and how she should encourage her clients to review this site so it would 'make her job much easier". You know what she said? "I do not want my clients on there, that's why they have me!" So basically in my humble opinion, the less the client knows, the better off they Esquire is because when that client receives a bloody RFE for them not having a specific document(s)... guess what? That attorney has the client 'fix it & submit the documents back to them", which in turn costs the client $$$$$ for them submitting the RFE evidence and a signed letterhead from them! *** now on the other hand? I have a very good friend of mine also in Immi Law and she is so honest, good and very forthright --- really her work is unremarkable. So Kudos to her!!! That being said, I have never believed in "not teaching" so they can learn for themselves.

Now in regards to what your expert legal has advised you? Please check yourself with your embassy as it is stated on the Dept of State Official Website that Byron will require a medical FIRST before his interview. WHY IS YOUR ATTORNEY UNCERTAIN? Ask her why the hell she/he did not check the DOS Official Website herself and tell you and Byron the actual, instead of this BS of tell you NOT TO READ and RESEARCH because it stresses you out! Afterall, THAT IS WHY YOU HIRED HER/ HIM! And what kind of "professional letter" was that!? "I'M NOT CERTAIN".... :bonk:

BTW, if the beneficiary has had the medical before his interview at Embassy, those records can be brought to the AOS medical; there is a place in the actual medical instructions on the DOS site (and it is referenced on our Thread Map under Medical info/ vaccines too from Official Website). I do not think the Official Dept of State website is confusing or inaccurate! If it was, then where has everyone who has gone through this process without an attorney gotten their information from???

Lastly, I got both the hardcopy receipt (says they have received our file) and the eNotification from both the NVC and Embassy within a DAY of them actually having the file! NOT ONE MONTH OR SO LATER. From Ankara Embassy, it says that you can download the documents (DS's forms,etc) from their website and no further packet 3 will be mailed out. I even wrote to find out if that was only for USC Petitioner or for both me and Kadir. They told me both of us. *** REMEMBER EACH EMBASSY IS DIFFERENT, so you can call the Main Dept of State who deals directly with each Embassy to ask. The number is listed on our Thread Map references.

I'm sorry but I disagree with your attorney when it comes to you reading and researching for yourself and Byron. Who's furture and life is it anyhow! If an attorney states they are uncertain, I can tell you right now they would get a scathing letter from me as their client as to WHY they haven't researched FOR ME and put in writing the answer to both ME and my Fiance! Especially, since I am paying them! Right??

You and Byron are going to come through all of this like a champs in the end because you two will be happily married and together!

Mari, you are right. I HAD written a scathing email response, and sent to Byron for review, and he - being the polite diplomat - told me not to send it and sent his own very nice and polite email about time limits, etc. Sooo....I am still upset but don't want to rock the boat any further :( :(

Honestly, up until today this attorney has seemed brilliant to me. The 'uncertain' comment rocked me though....why am I paying so much money for 'uncertainty'??? Aghhh ohhh I will have to think about this some more!!

grrr speaking of incompetent lawyers.. mine hasn't had the best track record with me. I hired him because I wanted to make sure we did everything right, since we really cant afford to go through this process again any time soon and I live in Mexico with Em, I thought that that little fact might complicate things.

But really the only thing thats complicating this whole process is my lawyer! First he was wrong about which consulate we would be using and now he's wrong about which affidavit of support we need (he thinks we need the I-864, when really we need the I-134) AHH :bonk:

woohoo we're almost all in pink.. just a few more left to go!

Oh Boy - now I am really worried!! Let me tell a quick story - when B & I went the attorney's office end of Nov together, an associate told us we'd get a notification they received our NOA1 in a week or so.....and should be approved in a couple months. NOT kidding. Over 5 months later...finally got NOA2. Not exactly confidence-inducing huh??

Hello to all Fellow December filers... :) congratulations to all who already got their NOA2s and for the one who hasn't yet...hang in there...there is always a light at the end of the tunnel.. :yes:

Now as I am trying to preapre for the next step...I am feeling overwhelmed at all of the information I am gathering...and even confused too.. :o plus the spring allergies not allowing me to focus...I need some help...can someone list the what next procedure step by step till the visa interview ?

for ex.

1. NOA1

2. NOA2

3. Processing at NVC

4. Pkt 3 or 4 ??

5. what forms to fill ?

6. Whe to fill the I-134?

I guess I know all of these but just too confused and overwhelmed to understand in exact manner... :wacko::innocent::help: please

Yep you got the order correct for the most part.

1. USCIS: NOA1 = original petition from USC * For K1's we have to prove we have met within the last 2 years prior to petition, and that the USC is really a USC.

2. USCIS: NOA2 = your file will now be sent forward to National Visa Center in New Hampshire! USCIS is finished with your file till after you marry and apply for AOS.

3.NVC: Processing and background checks: They're going to want to make sure nobody has a federal criminal record which might harm our US Homeland Security. As soon as you are in the system, they will assign you an NVC number for your Embassy! That's your new ID and this number should mark each page you submit with this Packet 3 file.

4 NVC sends your file to your assigned Embassy (bene's country)

5. Embassy: Now they send you a list of documents to prove that you two are engaged official and this is not a sham, that the USC can support the Bene, and that the Bene is who his documents say he/she is. THIS IS PACKET 3.

  1. The Petitioner and/or the Bene work on their file gathering the "list" which you can also download online on the Dept of State Official website. *** This is also on our Thread Map and I have posted the Map on Page 150 today updated (except I didn't update today's DATE! LOL LOL oops)
  2. When the file is complete, the Bene will send this to the US Embassy (assigned to you) via UPS or whichever the Embassy requires of you.
  3. You can make the appointment for medical during this time as well if the Civil Surgeon's offices are not far from you. Or you can wait till it's closer to the date you will interview.

6. Embassy will send you Packet 4: The letter of Invite for Schedule Interview and further instructions from them to the Bene!

7. Bene goes to Interview on said date with everything needed (Passport, fee receipt, medical records from civil surgeon, and original documents they want, including but not limited to further evidence for ongoing relationship.

8. Visa Issued!!! YIPEE!!!!!!!!!!

9. Point of Entry to the US: Now you have 90 days to get married!!!

10. Apply for Adjustment of Status after your marriage.

VSC have seemed to have slowed up over the past week, they could have least approved my 1-129f before they slowed up haha.

Ahh well, before June and I'll be happy. Just want to be in usa by mid august.

I am an attorney and I am not even hiring anyone to help us with this process. I have enough friends that practice immigration to ask for advice, I read the Nolo book on fiance visas and VJ is the best resource Ive found. Honestly, the only time you need to hire an attorney is

1) If USCIS claims you/your fiance' is inadmissible

2) If USCIS fails to act on or approve application because of bureaucracy instead of law

3) If you will lose your rights if USCIS doesn’t act quickly ( i.e., lottery)

4) If there is some reason you feel there is no hope of getting visa or green card

Your lawyer is incompetent! Fire him/her immediately.

K-1 process

1. December 19, 2010: Mailed I-129F

2. December 23, 2010: I-129F delivered

3. December 28, 2010: NOA1

4. December 29, 2010: Received email and text message from USCIS stating application was received

5. January 6, 2011: Received hard copy NOA1

6. May 2, 2011: Received email and text message for NOA2

7. May 6, 2011: Received hard copy NOA2

I am an attorney and I am not even hiring anyone to help us with this process. I have enough friends that practice immigration to ask for advice, I read the Nolo book on fiance visas and VJ is the best resource Ive found. Honestly, the only time you need to hire an attorney is

1) If USCIS claims you/your fiance' is inadmissible

2) If USCIS fails to act on or approve application because of bureaucracy instead of law

3) If you will lose your rights if USCIS doesn’t act quickly ( i.e., lottery)

4) If there is some reason you feel there is no hope of getting visa or green card

I agree VJ is the best resource I've found. I also read the Nolo book.. but I didn't even know it existed until like 3 months after we got the NOA1... for now I'll keep my lawyer, cuz he fills out all the forms for me.. even though I do have to quadruple check them ;-P we hired a lawyer because I just literally had no idea about the process and really didn't want to screw anything up. Thank GOD I found VJ or else we'd probably have gotten an RFE at the VERY least lol

So thanks to alllll you guys. You're the bestest!

I got an email and a text message at 7pm this evening :) It's my NOA2 from VSC !!! :yes:

It came after 160 days of NOA1 :)

I sincerely hope that those who are still waiting will get theirs soon!!

Can we talk about proof of ongoing relationship? Not proof of having met in the last 2 years for the I-129F I am talking proof of ongoing relationship that the beneficiary brings to the interview. You see being ignorant and brain dead to the ways of the K-1 visa process, I thought Jenie Bee would arrive here by late May early June, so for financial reasons and also she would have difficulty getting leave from work I scrubbed my March trip to the Philippines.

:bonk: Now we have limited proof of an ongoing relationship, here is what we have: phone records of our daily phone calls (I call her each day at 5:00 PM) we have engagement ring receipt and of course she has the ring. We have 40 million emails, also a letter from the pastor who will marry us (in the event she actually arrives here someday) and I have a deposit slip for the chapel. Oh, and she has a visa debit card that I sent in November we use that rather than Western Union. We chat on YM each Saturday but I have no clue as to how to get a transcript of that? We have not been together since September 14th :( Is this enough evidence or should I start job searching in Manila again? :wacko:
