K-1 denial based on previous denials???

Hi VJ,

I have a question,,,do you think that previous denials would affect my K-1 visa?? I've been denied 3 times for 2 kinds of visas ( 2 times for a student visa and 1 time tourist visa)

Please share your experience or opinion about this issue. we haven'e file the petition yet, and I'm so stressed out about it :(

A suggestion more than likely your income or US government

sees you as a person who will get to USA and stay & not return to Egypt.

So if you have a women from USA have her fly to you and get married

have her do the CR-1 visa to bring you.

the easiest way i see to get to the USA that way if not i dont see them

ever giving you any visa ever. If you been denied 3 or 4 times I dont see

them ever giving you a vidsa to enter the USA.

It difficult to get into the USA from your part of the world ( NO OFFENSE )

BUt USA is more stricter on any Visa now after 911

there have been others that have been denied those types of visa and had no problem with k1 or marriage visa...the kind of visa you had applied for before were denied on the assumption you would not return to Egypt prolly.......k1 or marriage visa they know going into it from the beginning you plan on coming to the USA to stay and live

I dont see any problem with your situation.However,u must be ready to answer to them on why u tried to go to the USA earlier on, with the finger print system, A gold fish has no hiding place.Just ensure u tell them the truth cos they already have ur record,any misrepresentation will result to a red flag.I was also denied once which was 2years ago,when I went for my Cr interview about 3 weeks ago I was asked about the denial and My CO was pleased with my answers.I wasnt given the visa simply bcos they needed an Additional documents from me but aside that every other things was fine.Just remember the answers u gave during those interviews, I surely believe u will be fine.

if not i dont see them ever giving you any visa ever. If you been denied 3 or 4 times I dont see

them ever giving you a vidsa to enter the USA.

Completely incorrect and utterly ignorant. The purpose of the visa is what makes a lot of difference in the application process. You don't know why those previous visas were denied, so you cannot possibly comment on the likelihood of their K-1 application approval.

Other VJ members have commented on their visa denials and, many times, beneficiaries seem to be denied because of previous and unrelated visa denials as the consul believes that the beneficary only has an interest in immigrating to the US. I am, of course, more familiar with these denials as a specific case to the Santo Domingo, Dominican Republic consulate (which is a high fraud consulate). I would recommend that you talk to other members who have completed the process with beneficiaries in Egypt as they would have more specific experience in the matter.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I'm in a similar situation, actually.

I overstayed by 4 days on the VWP last summer. After returning to the UK for a month, I (in ignorance) attempted to enter the country again on the VWP at the beginning of October. At the POE, I was ushered through to immigration where I was kept for an hour and (much to my relief) eventually granted a class B-2 waiver for 90 days. The CBP advised I apply for a B-2 visa at the London embassy for future visits.

This I did and was denied earlier this month. They said that I was practically living in the US, and thus pursuing an inappropriate visa. This, I have to say, was an absolutely fair assessment. My reason for visiting the US was to be with my girlfriend, and I made no attempts to hide this. I subsequently began to research, and we're now going through the proper channels with the K-1 visa.

I hadn't really thought my less-than-perfect visa record might cause difficulty with my K-1 application - does anyone think it might?

In general NO. But in a high fraud consulate repeated visa applications CAN be seen as one trying to circumvent th processof find a way...ANY way...to get a visa.

Should not be a problem provided you have adequate evidence of a valid relationship

My (now) husband was denied for student visas twice and we had no trouble with the K1. As long as the other visas weren't denied for something serious (like misrepresentation or something) and were instead denied for something like intent to immigrate to the US, you should be ok. Just get your relationship evidence in order and go read up in the MENA forum to get info about what your consulate wants to see.

I would make sure I brought plenty of proof of an ongoing valid relationship.. looking at it from an immigration officers standpoint, it could look like you are marrying to get in after previous denials. As long as you have plenty of evidence to overcome that objection, you should be ok!

If they follow the trend of your history, they might be convinced you just want to get to the United states by any means necessary. If your were denied because they thought you would not return, they might be inclined to deny a k1, as there have been cases denied because the COs were convinced the k1 was filed solely for immigration purposes. Going by your history, the best way is to get married in your country first, and then have the petitioner file a spousal visa for you. Would not be good to file a K1 only to be denied for the same reason after all the wait.

My Fiancee and I agreed to get married in 2007

I was denied a tourist visa about 18 months ago. reason was I don't have enough ties with my country.

So my fiancee traveled to Jordan less than a month ago and we got engaged.

Next is to apply for K1 Visa. I have a feeling everything will be ok this time

Here is the catch i see: If you have lied to the embassy on those previous visa applications and now if you file for K-1 visa, then you stuck! If the previous situations are very independent and you were denied based on their assessment of your situation completely valid, then there wouldn't be harm. I assume you might have to prove your relationship is "extemely valid & bonafide". Because they can think you are getting married for the wrong reason...

Will not have any affect on your K-1. You were told no to those other requests;that is not a bad thing.

I do want to immigrate to the US to be with my fiancé

and i dont want to get married in my country,simply because all my family live in the US. dad, mom, and sister. and his family too. thats why it makes more senese to want to marry there
