Hi guys!

I'm filling out I-864 (Affidavit of Support) for my wife (a K1 visa holder), who is applying for AOS (I-485).

I have a joint sponsor (my father), who is going to fill out I-864A, so there could be 2 sponsors (him and me).

My question is, my father doesn't live with me, so is he considered a household member?

I don't understand if I need to include him in my I-864, more specifically, in Part 5: "21. Your Household Size"

and in Part 6: "24. My current annual household income:"

Thanks a lot for help.

You do not live in the same house with your father so his is not considered a household member. When you share the same address then he is considered an household member. Hope that helps.

Thanks! But I-864A is called "Contract Between Sponsor and Household Member", so it's still unclear to me what "household member" in this case means:) Sorry for confusion:)

Your household is you, your spouse, and any children.

Dad's household is him, the immigrant(your spouse), his spouse, any minor children, anyone claimed as a dependent on his most recent tax return.

The instructions for the I-864A define who may be considered a household member:

For purposes of this form, a "household member" is:

A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)

if he doesn't live with you, then he has to fill out another i864. you would fill it out as the sponsor, your father will fill out his own i864 as the only joint sponsor. you don't include his in yours because he isn't a household member.

Guys,

We have here almost the same situation, my husband, the USC doesnt live in the same address that his father lives (our co-sponsor) BUT We will be living with him in the U.S and His address were our intent address to live in the U.S

Now, should this count as we being a household member? Let's have in mind that my husband address in all the forms was abroad, and he is not dependent on taxes returns.

My doubt is should my co-sponsor submit the I864A together too?

Thanks a lot!
