I just received request for evidence regarding the meeting in the last two years. It has been 6 months! (K-1) In the original application, I already submitted what is currently asking me to provide in the RFE. Does anyone experience this? I wonder if USCIS actually look closely to all the paper people send in.

1st email, May 19, 2009

1st visit, first face to face, June 17, 2009

2nd visit, December 24, 2009

3rd visit, engaged in Vietnam, June 6, 2010

Filed K-1, June 17, 2010

4th visit,December 26, 2010

INTERVIEWED May 21, 2011 --> RE: Additional documents

5th visit, both of us went in to submit additional documents on June 16, 2011---> Result AP.

6th visit, I went to the Consulate on December 28, 2011

Got back to the US and asked Congressman for help.

March 10, Asked Senators for help.

March 27, 2012 DoS status indicated an expedite on my case after Senators inquiry

End of March, Phone call from Consulate at 11:30PM.

April 13 (or so) received letter asked to update medical and police report

Received VISA April 28, 2012

well its 1 of two things then.

1. they lost your stuff you sent the first time. ( happens A LOT )

2. you didn't send enough proof for them or they don't believe that what you sent is enough.

So send more or send it again.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

So that we can help you (and you can help others, too) please make sure to fill in your timeline and be specific as to what the RFE says and what you sent. Otherwise, we really do not have enough information to go on to give you good advice.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Copy of airline boarding passes & itineraries (dated on boarding passes). I visited 3 times (June 2009, December 2010, June 2010), and I still kept all the original itineraries &boarding passes. My last trip was June, 2010.

The RFE asked me to provide itineraries, suggested photos with dated, and custom stamped on my passport. I would think the dated photos and the itineraries and boarding passes I sent will be enough. The custom in Vietnam only stamped my declaration form and took the VISA, there was no stamp in my passport. Luckily I still kept the declaration form with the stamped date for arrival and departure. Hopefully, they accepted the stamped declaration form because that is all I have unless they want tons of pictures.

Itineraries are absolutely worthless. They're not even useful for secondary evidence. You can go to any online travel website, make tentative reservations for a round trip ticket, and print out an absolutely authentic itinerary, without actually paying for the tickets or making the trip.

Boarding passes are good primary evidence. I'm curious why they didn't accept those in your case. Was your name also printed on the boarding passes?

It probably would have been better if you had not gotten the loose visa. I realize it's more convenient not having to send your passport to the Vietnam embassy or consulate in the US, but having an actual visa stamp in your passport means you'd also have entry/exit stamps in your passport. From what you've said about the RFE, it sounds like they want to see those stamped visas in your passport. In your response you should include a letter explaining why you don't have visas or entry/exit stamps in your passport.

Do you have any receipts from Vietnam for hotels, ATM's, or anything else you purchased?

No

They just need more evidence than what you sent. The VJ Guides tell you what to send and you need to send more.....and of the right type.

That one visa should have been enough. The entry/exit stamps are usually on the opposite page from the visa stamp.

Recompile your package of evidence. Include the boarding passes, customs declaration cards, copies of the visa and entry/exit stamps from your passport, copy of the bio page from your passport, photos, whatever other evidence you sent before or still have. Include a cover letter explaining that you had loose visas for your other trips and so did not receive any stamps in your passport. That one trip with the visa stamp in your passport is enough to prove you've met the requirement.

USCIS doesn't have to "buy time". There is no statutory requirement that they have to finish processing your case within the time frame cited on their website. Those are just average times, and they wouldn't likely lift a finger to help you find out what's delaying your case until you've exceeded that time. They can take as long as they need.
