So how come she did not run away in her own country? I would like to think she has family that would help, I'm sure she would have better living conditions i.e. shelter, perhaps. The way your describing the situation sounds planed by the undocumented woman, or others.

Three sides to every story.

There are lots of details to her situation that I'm not going to divulge here, but she is from the Philippines and left him (went back home) once, after their first child. But really that's irrelevant. She literally ran away from him while they were vacationing here in the states, to escape the torture. Was she planning to do this? Probably so, but she did so out of the best interest of her children, who are USC. While some of you think everyone who hasn't gotten through the "proper channels" to acquire legal status should be shipped off and deported, there are mitigating and unique circumstances to why some don't have documentation. Immigration law is not criminal law. We are a nation of immigrants and there are many avenues currently available to immigrate which most of us here have had the fortune of using. Justice isn't dictated by law - which is something that so many here can't seem to apply to issues surrounding immigration.

Every country is a nation of immigrants, including the Philippines.

If she fails she will be back home and the children will be in the US unless her Husband agrees otherwise.

Law and Justice occasionally interact.

It's beyond absurd to think that sending her back to the Philippines because her husband didn't file an AOS for her is justice. She married a USC and has two USC children by him. Some of you get all worked up over anyone who hasn't crossed their t's or dotted their i's, which considering that we've all been through the immigration process, is both sad and pathetic.

Since when does the Law always equal Justice?

Heck I'm surprised she was able to get a Tourist Visa having USC Spouse & Children.

While I do have sympathy for an abused woman (especially once she's actually taken action to end the abuse) I don't see how that is relevant to her situation.

Honestly she's made the situation more difficult for herself as he can prevent her from legally leaving the US with his children and probably doesn't have he family network here that she had back home.

It is an ill-conceived plan especially since for a VAWA claim I believe that the abuse has to happen on US Soil.

You said they came to visit, not immigrate.

I am not located in that part of West Virginia.
<shrug> I do know there are also desis in Wheeling and Charleston--which are way past commutable-distance to DC.
