I am filing for Adjustment of Status based on marriage to a US citizen.

My new father-in-law will be a joint sponsor for the purpose of the Affidavit of Support as my US citizen wife is currently unemployed.

Instructions state that the joint sponsor must furnish a copy of his most recent federal income tax return with his completed form I-864

He is very reluctant to provide a copy of the entire return and wants to know if a copy of just the W2 from his employer of over 10 years, and a letter of employment from his superior will be evidence enough?

I'm trying to encourage him to also obtain a transcript 'summary' of his income details for the past three years. He can get this from his tax accountant.

tax transcripts are free and it didn't take long for them to arrive. I requested 3 years of transcripts and they arrived within a week. Your father in law can call: 1-800-829-1040 to request or complete the request form (I just called the 1-800 number)

The main responsibility of a joint sponsor is to furnish the documents needed to determine their eligibility to be a sponsor. If they don't do that what good are they? If he wants he could put them in a sealed envelope and have you include that envelope with the application so that only the person adjudicating the case will most likely see them.

Wesley my husband was the same as your father in -law felt an invasion of privacy but I told him it was necessary and no one is going to be scrutinizing them. As said he can place them in an envelope and then only the clerk processing the case will see them. He has to submit tax return 1040 and w2 or transcripts for the last 3 years or just 2009. Otherwise you will get an RFE as we did, we submitted w2 and 1099 but they wanted the 1040 tax return.

Divorced !st November 2012.

Married only 2 years 1 month
