What are the best that we should bring to the interview?

Hi everybody,

I know my interview's date is unknown and we have a long way to go but I just wanna ask some questions so that I can be all prepared ahead. I was born to worry.

Here's our situation : My husband has been unemployed for like 6 months and I can't work either because I don't have a work permit yet. Since I came to USA, I've been living with him and his mom. She's so nice that we don't need to pay anything.She even paid for half of the form fees [ we used her personal checks for the fees]. So basically we can't open a joint account. The only thing he has is his car but the thing is its insurance is under his mom's name because he got it when he was 16. I sent her affidavit stating that we've been living with her and she paid everything along with my application already

And we don't have wedding photos because the wedding was just us but we have a few photos together before getting married. We don't have many of them since he doesnt like having his photos taken, he always blinks in them :) ,I did send them along with my application.

He thought our love was enough in the interview but after reading lots of posts in here, we absolutely lack evidence. We're afraid our lack of evidence could make them think its a fraud marriage even though our love is real. So we worry about it already even though the interview is long way to go.

So my questions are :

1. Are we supposed to have joint account no matter what? [ If yes, I can ask my friend for some money and when we can work again, we ll pay them back ]

2. What should we bring to the interview when we are in such a situation?

I really hope I can have work permit soon because I got a job already but I can't work :(.

11/19/10: I-693 sealed.It means my chest x ray is fine :)

12/13/10 [Day 21]: Texts and email received [ after 21 days!!!!!!!!!!!!!!]

12/16/10 [Day 24]: Snail copy received

12/18/10 [Day 26]: Every single form touched

12/20/10 [Day 28]: Biometrics letter received

1/13/11 [Day 51]: Biometrics done

1/24/11 [Day 62]: Biometrcis appointment received AGAIN.!!!!!!!!!I was like #######

2/04/11 [Day 72]: Second biometrics done

2/15/11 [Day 83]: EAD in production.

2/18/11 [Day 86]: Interview letter received, set for March 21

2/22/11 [Day 90]: EAD mailed out.

2/25/11 [Day 93]: EAD received

3/21/11 [Day 118]: Interview but left with no decision ToT

3/31/11 [Day 128]: RFE regarding police clearance

4/13/11 [Day 141]: RFE sent

4/19/11 [Day 147]: Card in production

4/22/11 [Day 150]: Welcome2USA letter received

It took 5 stressful months exactly.

I would open the joint account, there is no stipulation it has to have a huge amount of money in it. Get lots of pics of you together since you got married with different friends in different places. Take a joint credit card out in both of your names.

You probably won't get a work permit for another 2 months.

It doesn't matter the amount that you have on your joint account BUT you need to show an active account history. Use that bank account frequently!

You can have his mom writing an affidavit showing the living arrangement.

Also, have copies of her personal checks that she sent to USCIS for your AOS filing fees. That is also a good proof, you actually show how his family is actively involved in your life as a couple. She can get that from her bank statements.

I had a copy of these personal checks from my husband's parents, when we were looking to close on our house. The IO was pleased to see that they were helping us financially in purchasing our first home!

06-06-2017 - Credit card charged; received text and email confirming that application was received and NOA is on its way

06-10-2017 - Received NOA letter from NBC dated 06-05-2017

06-16-2017 - Received Biometrics Appointment Letter for 06-28-2017

01-19-2018 - Interview Letter sent

02-27-18 - Interview and Oath Ceremony. Finally US CITIZEN!

03-15-2012 - NOA received, dated 03-12-2012

Timeline

You need to show a true relationship between the two of you.

How long have you two known each other? How long have you been living there with his mom? You are adjusting from a J1 correct? So you've been in the US with your now spouse for a good amount of time. And you've just been married days before your grace period was to expire. So you want to show your lives together and how it has grown to become a recently married couple. Joint accounts are normal. Joint memberships, being listed as a driver on his car insurance, etc. Affidavits from friends that know the both of you may be helpful in documenting the evolution of your relationship.

Worst case sscenario: If you can't show evidence that the relationship is true and not just for immigration purposes you could end up being very disappointed and the AOS petition is denied.

So go through your history and pull up photos, travel itineraries, invitations, mail, etc. that show you two doing things as a couple for the length of your relationship, not just since marriage.

He picked me up at the airport.Ever since then, I've been living with him and his mom so that I could save some money from not paying for the rent and also be with him. We didn't plan anything . I bought a round trip ticket because we weren't sure if we were really meant to be before we met in person. After living with him for 4 months, we realized we couldn't live without each other so he proposed me. I got married on my grace period.

Submit chat transcripts from when you started talking online too. The more you can show the development of a relationship the better your case appears.

Maybe a stupid question but if at the interview they do not belive that the marriage is real, would this be the end of the journey or do you get a nother chance of proving that it is for real?

04/2006 - came to US as L1 employee

04/2010 - got married

11/2010 - submitted AOS package (I-130, I-485, I-765)

05/2011 - Welcome letter arrived in the mail

11/2017 - Filed for naturalization (Online Houston office)

11/2017 - Biometrics

06/2018 - Interview (passed)

06/2018 - Case approved notification

If your spouse came in as a visa waiver then it is the end of the road for you. If you are adjusting from any other visa you will have an appeals process to go through.
