I have a question and would really appriciate an answer. I have a friend who is a citizen of the United States. Her and her husband had adopted a boy back in 2005 from her cousin. She would like to petition for her adopted son now. Would this be easier if they send in the I-130 to USCIS or would it be easier just to file in the Philippines when she goes back home for the winter.

question 2: I see that an adopted child must live with the parent for at least two years but what if the child is attending school away from home?

If the child was not a orphan then she may not be able to petition the child. One of the rules is that the parents have to be deceased. It prevents people from adopting relatives to circumvent immigration laws. The are loopholes but they are a pain. I am sure some someone will answer soon

This will not be over quickly. You will not enjoy this.

This is correct. A friend is attempting to bring two " adopted" kids here & has found its a real Pandoras Box. The laws & procedures should be completly understood before any attempt is made. This can be a very difficult process from what I have seen so far.

01/14/11 - Approval Notice I-130 & Welcome Letter!

01/18/11 - Received Green Card in the mail..
