Hi everyone,

Happy Holidays :))

I wanted to ask about the proposal,,,should it be in person??

because my fiancé proposed on the phone and he was intending to give me the ring on FEB when we meet in Paris. He did this so we can save time and start our K-1 producer the month instead of waiting until FEB.

The lawyer said that wouldn't make sense to the people at the embassy and they might deny me because of that.

What do u think??? I need your advice

I started my K1 before I technically proposed. The only real issue with starting is that you have met in person before you file (which I had done). Other than a possible question during the interview, I don't think anyone is going to care how big the ring is, etc. Just make sure you have met in person *and* have some evidence of that meeting (photos, ticket, etc.) before you file.

we met 3 time in 3 years

and we have a lot of evidence,,,Photos,,, call log,,,chat history,,,emails,,,,gifts and card from him

Based on the fact that you have met in person in the last 2 years, in my opinion there is no reason why you couldn't file your petition today.

01-27-11 - Passport received; visa in hand

02-08-11 - POE - Fort Lauderdale, Fla MISSED FLIGHT; 02-10-11 - POE second time's the charm. Easy POE. Welcome to the USA.

03-04-11 - Married

AOS

05-08-11 - Mailed out I-485, I-765 & I-131;

05-16-11 - Text & email msgs with Receipt Number

05-17-11 - Applied for Expedited AP as Victoria's mother was very ill; 05-18-11 - Picked up AP document

05-20-11 - Victoria returns to Colombia; NOA1 for all 3 forms arrive

06-03-11 - Text message "Case now updated"; RFE 06-07-11 - RFE arrives for 2010 Tax Return

06-08-11 - Text message "Case now updated"; Post Office returned a letter that was sent by USCIS; 06-09-11 - Issue resolved

06-14-11 - RFE response sent; 06-21-11 - Text message "Case now updated"; RFE response under review

06-29-11 - Text message "Case now updated"; Case transferred to CSC

08-30-11 - Victoria returns to US

08-31-11 - Biometrics done; Text message - "EAD Card Production ordered"

09-11 - Case transferred back from CSC

11-22-11 - Interview in Albany Field Office. AOS APPROVED.

I finally looked at your signature. If you have photos of you, you fiance and your family together (everyone has to be in the photo) that is a good one to include. I went with just photos and copies of our passports. Since you have met, there's nothing stopping you from starting your application.

Some cultures expect big engagement parties, others don't have a clue about what an engagement is. You have to follow cultural norms. In the cultures that don't have engagements is it more about what day did you decide you were going to get married. In cultures where parties are the norm you should have a party. It doesn't matter what other did unless they are couples from the same cultural group.

This will not be over quickly. You will not enjoy this.

I say go ahead and file you dont have to have the ring before you file if you file now and get the ring in Feb dosent make any difference....Good luck with your decision

I think you need to get rid of your lawyer. There are no guidelines set by USCIS determining how the "engagement" needs to take place. Actually, you do not even need a ring at all. All that matters is that the two people are free and willing to marry and that they have met, in person, within the last two years of filing the petition. So, you might as well send in your petition ASAP and get the ball rolling because it will take months for your petition to be adjudicated!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

That's all that matters for USCIS, but Egypt is a high fraud consulate and perhaps the lawyer was advising that a phone proposal would look suspicious to the CO's. There are plenty of cases denied everyday at the consulate level, where the couple met the requirements but failed to convince the CO that the relationship was genuine.

I think Nigeriaorbust gave great advice.
