Hi All,

I got married to an US citizen and got my green card February 2009. Last month applied for extension and filed I-90 and paid $360 for this :bonk: , and today I had biomed appointment I went to office, and learned I should have filed in i-751. They said they are not giving the money back of course, i should apply again with 751, they can do my process and extend my card, she said I guess 6 months, but I have to reapply.

is there a way, if i go to this appointment again, and if they give me visa till feb, 2012(i will be 3 years green card holder and can apply for citizenship), can I go from there, or there is no way to pull this off I have to do what they say and fill 751 and restart?

ps. me and my husband, we both are students. 360+540$ is gonna be too much! that's why I am this desperate. (and probably asking an ignorant and obvious question like this. so plz be undeerstanding and gentile :) )

The removal of conditions step is different from the renewal of an unconditional green card. You will have to file the I-751 and submit all the required supporting documentation.

If you get a visa, you are then basically giving up your permanent residence status. Then you have to go through AOS again.

Bite the bullet and apply for I-751.

N-400 Naturalization Timeline

06/28/11 .. Mailed N-400 package via Priority mail with delivery confirmation

Thank you, guys! I got confused bcos of "conditional" thing; they never said I am conditional resident on any of the papers, letters they sent to me till this point. they kept saying "permanent resident", suddenly I became conditional. That's how I screwed : (

Well it's easy to know if you're conditional or not - 2 yr GC - conditional, 10-yr - not conditional. Married for less than 2 years when residency approved or entered POE - 2yr card.

File for I-751.

ROC 2009
Naturalization 2010
