I am looking for advice regarding the possibility of filing a lawsuit against USCIS, and how/where to find a lawyer who would help.

The story is such:

I was married to US citizen, became a vicitm of domestic violence (no need to say - it is hell), filed I-360 (VAWA)...which is pending for almost 29 month!!!. During all this time I was not able to legally work (I-360 does not allow you to apply for work permit until it is approved), was not able to live the normal life - i suffered from clinical depression, was on medications all the time. What i try so far

5 inquiry to VSC in writting

4 inquiry thru the senator every time different respond

1- Your case is waiting security Clarence that was 14 month ago

2-Your case with an officer for final adjudication decision will be mad with in 45 days (that was 11month ago

The last 2 inquiry was your case under review uscis cant not give NO date when your case will be don

3 inquiry thru CIS ombudsman and all the same BS I’m rally getting tired of that

I am a young intelligent man,i have no criminal record, I always obeyed immigartion laws, i suffered through enough already to go through all this. So...I am looking for advice on what I can do, especially about filing a lawsuit..

By the way i have very strong case never got any RFE i don’t understand i see people getting approve with less evidence than me

This is effict my life so much i need to get decision any opinions are very appreciated

you choose to remain here and claim vawa/ they are processed in 5 months however certain cases are not processed within the given time frame. It is hard no tbeing able to work it's not right.

I can see your claim of not having work permit is not correct. while filing WAVA if you would have filed I 485 as well as I 765 you will be allowed to get work permit. I guess you did not applied cocurrently or I guess you never filed I 485. thats why you are not allowed to get work permit.

WAVA claims takes time and RFe is must.. First RFE comes sooner as Vermont will as the proof of No criminal history and will send list where to obtain the report and how to send it.

Prima facie eligiblity comes within 30 days of filing if filed correctly.

Next step is to evluate the proof of claim.. if you send it with original application than you will get no Rfe otherwise RFE will be issued. then only result will come. There are one more background check will be done in background against DACS. If any flage comes then system will put alien into secondary level background check which is severe and it has no time limit.

Alien has to be cleared in both background checks.

you can't sue USCIS because your WAVA is pending for so long. You should remember that WAVA is a relief for the battered spouses. USCIS is alredy covered when they issue you Prima facie letter so you can get public benifits. Now its upto you if you want to be on public benifits or not..

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009

July,17 2009 : Prima facie approvel received.renewed again march 3, 2010

February 2, 2010 :I-765 filed, : denied

August 12,2010 :RFE issued on WAVA, more evidence needed.

sept 3rd 2010 : I-765 filed again. 9/15/2010:Filing receipt received.

Sept 15,2010 : REF answered with all evidences.9/17/2010:RFE recvd by USCIS.

Sept 19, 2010 : I 765 approved.

Sept 19,2010 : I360 touched. status changed to RFE Under review.

sept 20th 2010 : I 765 card production ordered, No Biometric, no picture etc.

sept 21 2010 : I 765 touched, still card in production.

Sept 22,2010 : I-765 touched, Card in production.

Sept 23, 2010 : I765, touched, Approval letter mailed. Card approved (???)

Sept 24,2010 : I 765 touched again. No change???

Sept 27, 2010 : EAD received.

october 3, 2010 : old expired EAD from last year touched (#######?)

October 5, 2010 : I 360 touched.

October 12,2010 : I 360 touched. Acceptance letter issued.???

Oct 13, 2010 : court date with IJ. I,m my own lawyer.

oct 13, 2010 : I 360 touched.

oct 14th2010 : I 360 touched

oct 15 2010 : I 360 touched.

OCt 20,1020 : I 360 approved.letter received.

oct 25 2010 : I 360 touched.

april 20 2011 : court date. I,m my own lawyer.I expedited my date: filed I 485, new date January 9th 2011, case terminated.

may 9th 2011 : I 485 interview.

MAy 25th 2011 : Card production ordered.
