As Inky says, you cannot have him deported. But you can file for divorce, talk to the police about the false claim, see about protection for yourself while you get him away from you, and move on with your life. You cannot "punish" him in any greater way because he is an immigrant as opposed to a natural born citizen. So don't bother thinking in those terms, and just think about your situation as if it were any other failing marriage. (Get a lawyer.)

Actually, if he has filed police reports on her then he might be able to get an order to have HER removed from the house.

You are correct, though. He has a 10 year green card. Unless she has evidence he obtained his visa or green card fraudulently, or is guilty of some deportable crime, then there's nothing she can do to have him deported. Cheating on her is not a crime.

Sorry to hear about your situation. Unfortunately as the others mentioned you can not have him deported.

Your best move is to not have any contact with him as this can make it easier for him to file abuse claims from the contact (even if they are false). And as everyone else mentioned as well, change the locks and "remove" him from your life as much as possible (locks, end phone contracts, etc).

Best wishes as you move on from this!

Please be careful with this "change the locks" advice. Depending on the circumstances, what you're advising her to do may not be legal, and she may get into trouble if she does it. For example, if his name is on the lease then he's a lawful tenant, and she cannot lock him out without a court order.

If they had been married two years by the time the GC was issued, then it would be for 10 yrs (Rin did not get her GC until Nov 2008, married Oct 2006 - received 10 yr card).
