I-134 and I-864 questions galore

Hi folks,

First of all, I apologize for all the questions. I am the petitioner residing in Canada with my Canadian husband who has an interview scheduled in early March. I was just reading over both the I-134 and I-864 forms and realized how many questions I still have about filling out these forms.

Thanks in advance to anyone who can answer any/all my questions.

1) On Form I-134, question 1 essentially asks you to specify either where you were born in the U.S., your certificate of naturalization or your certificate of citizenship number. I wasn't born in the U.S. and don't have either numbers. I do have my official report of birth abroad - will this suffice with a written explanation?

2) On Form I-134, you are asked to fill in your place of business in question 7. Currently, I still work in Canada and while I will be keeping the job for a while when myself and my husband move to the States even though it will still be with the Canadian company. I'm assuming I would still specify that job in question 7. Am I right?

3) Secondly, for question 7, can I only list my U.S. assets or can I list all of my assets?

4) On Form I-864, you are asked to specify your sponsors mailing address and place of residence. My husband and I will be beginning a lease on an apartment in the U.S. prior to his interview to help prove domicile. Should I specify that place of residence or our place in Canada where will still actually be living until he passes the interview?

5) On Form I-864, should I be specifying my country of domicile as Canada still even if we do have an apartment in the U.S. by the interview date?

6) Even though we will be residing in the States after the interview, I will be earning Canadian income from a Canadian company for the next little while after the move. Can I still list this as income on form I-864. If not, do I really, honestly specify that I have $0 income simply because the money i'm making is for a Canadian company?

7) If we use our assets to supplement our income on form I-864, do the assets all need to be in the U.S. or can some of them still be in Canada? I'm assuming that if they can be in Canada, I will need the dollar value of those assets.

I believe that's it for now. I'm sorry again about all the questions, but I am definitely a bit confused. I realize every situation is different and some of my questions may be hard to answer, but I really appreciate any help people can provide me.

Thanks again,

- Sam

The I-134 is not applicable to you in any way.

Only income that will continue from the same source after you move to the USA will be considered.

Read the I-864 instructions regarding using assets. They are excellent. Interpret them literally.

Facts are cheap...knowing how to use them is precious...

You're right about the I-134. Thanks for clearing up that bit.
