GETTING MARRIED IN PH WHILE WAITING FOR NOA2

Timeline

My fiance is here with me and my son in the Philippines he will be here for 6 months. Our K1 case still in process and were waiting for NOA2.(almost 5 months but still no NOA2.) We are thinking about getting married here in Philippines so he could apply for a permanent resident,is that possible?- because it would be cheaper to apply for permanent resident than to spending money for his extension of stay fee's for 6 months. he really wanted to be with us for long time and yet also he wants us to travel together when my visa gets approved. whats the best thing that we can do?.. please help!..

Any response and suggestion will highly appreciated! :yes::help::help:

Don't do it. You will invalidate your K1 case and all your waiting will go out the window.

N-400 Timeline

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Timeline

Keep in mind this will be abandoning the K-1 case and you WILL be starting over with filing for a CR-1 visa by filing an I-130 for spouse and filing an I-130 for step-child.

Note if child is 18 or older at the time of marriage, then husband will not be able to petition for "Step child" and step child would have to remain behind, this is NOT the case for a K-1/K-2 case, however K-2 child would need to adjust status before age 21.

you can't get married while waiting for K1 approval. if you do, you have to start a different process altogether (CR1). right now the only thing you can do it wait and pray that you'll your NOA2 soon and pay for your fiance's visa extension (it's still a lot cheaper than if you blow your K1 chances for approval.

In this case, then no I-130 for a CR-2 visa for child. The Child should have a US Passport from filing birth abroad at the consulate.
