I know this has been a popular topic here, but I have a different situation and was wondering if I could get some input. I am moving back to Colombia to be with my wife until she gets her visa so I am going to file all of this before I leave. I am living with my mom and I have put her address on all visa related forms because it is my current domicile. I know that she would qualify for I-864A, but I am wondering if I should have her fill out an I-864 form because I am leaving for a few months. Here are my main concerns:

1) IF I fill out I-864 (not a problem, she has enough income without me), NVC sends it back and asks me for I-864A.

2) IF I fill out I-864A, the interviewer asks me why I did not fill out I-864 after I tell him/her that I have been living with my wife for a number of months.

I really just don't want any problems because of delays involved in my case already...any thoughts on this? We have no problem filling out I-864 's instead of I-864A and Im leaning towards this, just hoping it doesn't get sent back. Thanks for your help!

7/2/10- NOA1

2/9/11- NOA2 (transferred to Texas)

NVC

2/28/11- case number received

3/2/11- Paid AOS bill

3/5/11- Paid IV bill

3/12/11- expedite to Bogota consulate approved!!!

3/14/11- left NVC to Bogota for further processing

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!

You still need to file an I-864 and your mom needs to fill the I-864A you have to send both.

That's correct because the US domicile of the petitioner is the same as family member acting as sponsor. The petitioner will be on an extended visit to Colombia but probably not technically authorized to "reside" there. Either way the above is the correct procedure for the affidavits.

woops, yes I didnt mean IF I file I-864A, meant if she files that :) Anyways thank you for the advice :thumbs: Does my household member need proof of US citizenship like joint sponsors do? I will include my birth certificate and bills to provide evidence of being related, living at the same residence...just making sure this is enough!
