Ok, my wife's case was filed at the Chicago office around mid-August of 2010. The case was transfered to CSC around mid September and it was supposed to be faster, but I wasn't. So, it's been about four months since we filed the case. Is this normal? The case has been at CSC for three months now. I know that a couple months ago, the wait time for approval was 4 months. Is it still the same? and is it 4 months since the day you filed? or 4 months since the day it got transferred? I've heard of some people been approved already and they filed around the same time we did, so I am kind of worried. The expiration date on her K1 is tomorrow. Should I contact USCIS????? and does anybody know the phone number to call? I've tried the number on the last letter we got but you the automated system would just tell me that the case was transferred to CSC and the date. Is anybody going though the same????/

CSC has not been "faster" for a while now with greencard issuance. People are saying its faster if you get an interview for greencard at your local ASC.

The K-1 technically expires when it is used so that date doesn't matter now as long as you married within the 90 days. Having said that how has it possibly been almost 4 months since you filed for AOS when you state that your K-1 is about to expire which is supposed to be 90 days since you entered. That doesn't seem possible....

The K-1 technically expires when it is used so that date doesn't matter now as long as you married within the 90 days. Having said that how has it possibly been almost 4 months since you filed for AOS when you state that your K-1 is about to expire which is supposed to be 90 days since you entered. That doesn't seem possible....

The K1 is good for 6 months (of course, you can enter the US only once). The I-94 is for 3 months. She came here in June, got married in July, and filed in August. So, she has been here for 6 months, married for 5 months, and the application filed for 4 months if that makes any sense.

She is now in a NEW period of authorized stay. Her status is "AOS pending." Her K-1 and all of those expiration dates are irrelevant now. She has to wait for her GC now, and is permitted to wait here (in fact, she MUST wait here) until she gets it. She will get it. Don't worry. Probably very soon too.

Thanks, it's just that all of us would like to be approved right away. Hopefully we will get it soon. Is anybody else going through the same????? over 4 months???

We filed in Febriary of 2010 and finally had our interview in early November. Since the interview we have yet to hear anything, let alone receive a GC. We call and they say we must wait 90 days to submit an inquiry. So right now we are in limbo, anxiously waiting to find out our decision.

4 months is not very long, actually. While some applications are approved within that time frame, many people take longer than that for their AOS applications to be approved - for instance, my green card took 22 months to process (no RFE, no security problems, no nothing - just a long wait), - 8 months of which were after it was transferred to CSC. A transfer to CSC is considered faster because it means you will not have to be scheduled for an interview - it doesn't mean that the processing of the application itself will go faster. Fall is a busy time of year for USCIS processing all sorts of employment based applications and family based applications sometimes slip to the back burner for a while so approval times may take longer in the second half of the year. You are still well within normal processing times.

As explained above, the K-1 is issued with a valid date of 6 months - which means that it has to be used within those 6 months, not that it confers legal status for 6 months. It is an entry visas only - once it is used, it is used up - expired. The I-94 then becomes the important document. It is issued for 90 days and to fulfill the terms of the K-1 you need to marry within those 90 days. Ideally, you should also apply for the AOS within those 90 days but it isn't a requirement. Once you apply for AOS, as stated above, your status changes and you are now an " AOS Pending" with a an authorized period of stay until you receive the green card or it is denied. If you apply before the I-94 expires, then you are never out of legal status. If you apply for AOS after the I-94 expires, then the time between its expiry and the AOS is accepted is considered 'out of legal status'.

So, relax, your wife is still legally in the country and there are no repercussions ahead of her because of expiring 'dates'. She should receive her AOS approval soon. In the meantime, enjoy your first Christmas together as a newly married couple. :)

My Husband and I have been waiting for his GC for 6 months and 2 days. We called the 1-800 number to have our case expedited twice. The first time they told us to give them an additional 45 days, that's gone! The second time they asked for an additional 30 days!! I am frustrated and so tired of waiting - especially when I see others quickly passing us up.

Yes I am we filed in June and our case was transfer to CSC in late August and we are still waiting for a interview date and or greencard.

We also got touch on Dec 2, 2010 and filed our AOS back in June,Uh I wonder if we have the same CO.

Hmmm, Very possible we could have had the same CO. On the bright side we was touched again on Dec 28th and they stated Green card production has been ordered. Appears this part of our journey is completed. Hopefully you will receive the same news soon. Good luck!
