My other friend is illegal,she wanted to apply for an asylum within 1 year of her presence here but her grandmother was sick so she was focus on helping her by sending money to her mom,her grandmother died 4 months ago and she wa going to leave USA to go to ukraine to see her for the last time but she was scared!she changed her religion from cristian to Muslim, that's why she wanted to do an asylum at the first place.in Ukraine people are cristian,no one is covering the head and there are groups of people who actually are racists and they could beat her to death or kill her,plus there is no mosques in her city and halal meat(special way of killing animals)it was her second time in USA, first time she returned in time,second time she was going to go back to her country but she met people who taught her Islam,and after half a year she accepted it,she even applied for a master in her university back home before coming here,she had j1 visa,she has just two b grades for the whole four year of study.now can she do an asylum after being here 2 years or no?

From reading your other post and this one, it seems like '' your friend'' is just trying hard to stay here ,looking for any way possible (which is her right to do what she wants). USICS people dont give asylum to everyone who asks about it whatever the reason is, without looking thru everything. They wont buy the story of her conversion to islam and what will happen to her in Ukraine. there are lots of muslims in there :http://en.wikipedia.org/wiki/Islam_in_Ukraine , lots of mosques and i am sure there are islamic markets. I am a muslim and i practice it and islam is my life and i just eat the meat that i get from the grocery stores here. I dont think asylum will be a good idea.

I thought this forum is to help people and not to judge, but anyway as you are a Muslim you should know that every " true" Muslims needs to pray 5 times a day,in Ukraine it's impossible and here you can take a 10 min break, plus whatever you say there is not a mosque in every city,in hers they don't have one,and as you know by religion she needs to marry just a Muslim, there is no Muslims in her city as she knows or if they are,there few of them.plus if she would like to have kids there is no Muslim schools there and they will teach them cristianity,is it ok too? Do you imagine your life like this?

Why are you shouting at the poster b/c she spoke the truth to you. You did come here for advise. Filing for asylum is not easy nor straight forward. I didn't see anything in your post that would warrant for asylum either.

She can apply. Can your friend prove that there is great danger for her safety if she was to live in her home country? This is her job to prove, not the USCIS to do the work. So your friend must prepare well if she hopes to have success.

The reasons that you gave would not be convincing. Your friend should talk with a qualified immgration attorney to learn if she can be successful.

You can not looked at the link you were given:

Muslims in Ukraine have 445 communities, 433 ministers, 160 mosques with many more mosques being built.[2]

In Crimea the Ukrainian Muslims make up to 12% of the population. At least 30 Ukrainian Muslim communities work without official registration (there are nearly 360 registered communities or organizations). Others groups include Chechens or Caucasian immigrants or settlers, as well as a few Afghans. Major languages are Tatar, Turkish and Caucasian languages such as Chechen or Avar. But all communities speak Russian and many also speak the Ukrainian language.

I can not imagine that your friend does not know this?

Ok, did anyone hear what happened in russia in Moscow on December 11? Kids and teens got beaten and even one got cut with the knife,age from 9-14,16, cause there are not Russians,not cristians or looked like ones,Russia and ukraine are post soviet countries, and the way people were thinking for 70 years during soviet union didnt change during almost 20 years,even got worse as the economy got worse and a lot of people already angry and frustrated cause of the lack of jobs and because of this personal problems.and if saw the news about how Ukrainian government were trying to kick out from their homes and land the only Muslim people who lives on the south of ukraine where my friend is from.do you think a Muslim can live there?

I didnt mean anything wrong, i was just commenting on your post, your friend's reasons wont convince them like Anh map said too. See it this way : Racism is everywhere and anti-muslims are everywhere, there were many mosques in the U.S attacked and still, just the media doesnt show that, muslims are attacked here too and lots of women with scarves on their heads are attacked and verbally abused.

We are just trying to say that it seems hard for her to get asylum. Why not check with islamic community centers in here area, and if she is really into islam and wants a muslim husband, she may find one and adjust her status. They usually have some type of marriage program, women and men seeking marriage apply.

Thank you "dolphin 1" for all your advices but I still she could work it out. Muslims don't have rights in her city, they don't want even to build a mosque in her city, women can't get a pic on a passport in hajab, won't be possible to pray in time and I wouldn't recomend her to go home and to get abused and proof that her being scared was not meaningless.at least here are the laws against of religion rasism

Sorry. The risk of persecution would have to exist in the entire country, and not just the town she's from. In addition, she would need to provide concrete proof that the risk of persecution is credible, and not simply anecdotal stories about a lack of Mosques or halal meat markets. Muslims are not required to pray in a Mosque. If they can wash and face Mecca, then they can pray. There are, in fact, some fabulous Mosques in Ukraine.

The halal meat problem is also easily solved - buy live animals and slaughter them yourself, or don't eat meat. Most sects of Islam also accept that they can eat meat from an animal that was not killed in a halal fashion if that's the only meat that's available.

In any case, both problems can easily be solved by moving to a city with a substantial Muslim population. Given that there are as many as two million Muslims in Ukraine, this shouldn't be difficult to do.

In addition to not understanding asylum, you also don't understand racism. Islam is a religion - not a race. If a person is persecuted because they are an Arab, then that's racism. If the same person is persecuted because they are a Muslim, it's not racism - it's religious persecution.

That's right, i myself cant go to the mosque everyday, praying at mosque or in group is 25 times better than praying at home or alone. But in my situation i pray at home, because i cant take time at work to pray, there is nowhere to do so, and i eat the meat from the grocery stores in here like i said before. Islam is flexible.

The things that she is affraid of, exist in here too, you cant live if you are scared something will happen to you.

What we are trying to tell you ULchik is this kind of asylum wont work for your friend, USCIS wont care if she cant pray at mosque and cant find halal meat or Ukranians will harass her as she is a muslim, and they know that happens in some places in this country too. The may deny her asylum and they will start the removal process and she will be deported. So it's better for her to search for another way.
