So as you can see we have received the visa, and could not be more excited.

Tanya has been asking me a lot about what the process is for working once she gets here. From my understanding we need an EAD card for her to be able to work, but I could be wrong. I work for an international IT health company as a QA Engineer, and I am talking to some people here who came here for school, or to work, and a few started working right away. The one girl said she came here with her husband, and within a month had started working here with no problems.

So my question is what do we need to do to get ready for Tanya to work here? Of course I want her to relax, and adjust to life here, but she is an anxious person which I adore. She said she would be much happier working, but of course I told her to do what she wants. So I just want to know what we need to do. Most of the posts I found on the Work Visa forum were aimed at people hopefully coming to work here, and none of them it seemed were married to an American. I know ours, like all of you, have the same situation as me. Is there a page on VJ, or State Dept website, or another forum that outlines this process?

What type of visa??

CR-1 spouse? CR-1 is a green-card visa, and gets green-card status the moment they enter the USA and can take a job.

K-1 is a fiancee visa, and has to marry and then adjust status, while adjusting status, they can file for EAD which can take up to 90 days to get after filing to adjust status.

Moving this, it is not specific to Russia.

yes you would have to get married file for AOS and she will then get an EAD card that would allow her to work......

To get a EAD you would have to file for AOS. Once she arrives here in the USA you have 90 days to marry, once you are married you can file for AOS. It should take about 2 to 3 months for the EAD once you have filed AOS.

Prepare her to have a few months where she is sort of in limbo. You can minimize that limbo time by marrying quickly and filing AOS asap after marriage. Good luck!

OK, it is a K-1 visa. I know about the 90 days to get married, but it seems we should get married within a month or so of her getting here so we can file the AOS and EAD paperwork.

So there really is no way around her working sooner? Unless she is picking apples on a plantation somewhere.

I am OK with doing whatever she wants to do, but I know she will be ready to get out of the house ASAP. I may even being able to work something out with my company to have her come in to volunteer or something to see where that would take her. I'm sure they would love the help, and it could def help her get a foot in here. In the meantime she can learn more English, the Pittsburgh Steelers and Penguins, hot wings, and maybe meeting some people along the way.

No sorry, nothing you can do sooner to get her to work. Some airports will issue a 'work authorization' stamp in the passport which confuses a lot of people. That stamp is useless, so if one is issued to you, do not get excited. A K-1 holder is not work authroized until EAD is in hand or the green card

Volunteering is a great idea.

That stamp is not a valid work authorization document according to the I-9 form anyway. The fact that they stamp that is basically wrong and confusing. A K-1 is eligible to apply for work authorization. They can work if they have a plastic EAD card in hand (which is a valid work authorization document). However, their authorized stay is 90 days, and the EAD application takes about 90 days to process, so any EAD card they get before their 90 days are up will just expire in a few days (with their I-94 expiration).

Bottom line: OP will have to wait to file for AOS (or should, anyway).

Oh they do, but it is useless. You cannot work with a 'work authorization' stamp in the passport of a K-1 holder. Maybe years ago, but not now
