hi,,i haven't gotten my NOA2 yet but we want to gather informations. . .my husband moved to the US this June 5,2010. He's been working for 6 months now, 2 months ago he got another job (so currently he has 2 jobs). my question is. .

1).can he file an ITR? or he needs at least 1 year of work to do so?

2.)will it affect our case? (we already have joint-sponsor lined up)

3.)will the employment proof and pay-stubs be sufficient?

4.)What if we cannot provide federal tax return?

i'm sorry if some of the questions are a little bit crazy. . .see. . .we don't know much about immigration stuff. . (both me and my husband 24yrs old ) most of the time we research,,,good thing i found this site. . .ask around. .

1) Should have filed one for 2010, even if no income last year, can file a ZERO return late, the I-864 requires past years IRS returns or a good explanation why one was not filed, it is easier to simply file a ZERO return than to explain why no return.

2) If have a joint sponsor then, no should not affect case, however, petitioner still needs to provide an I-864

3) Yes, and again I would attach a copy of a ZERO return for last year.

4) File a Zero Return late and attach a copy of the return to the I-864

If he has even one day of work then he must file a tax return. Many people will tell you that as long as he didn't make $600 then he doesn't need to file or report this. That is completely wrong. The employer doesn't need to report wages less than $600 but the filer must report everything. The employers should provide him with a w2 or a 1099 (this is where the $600 comes in to play). Even if he is self employeed and acting as a contractor, they should be providing him with a 1099. If you are already legally married and he has a SSN in the US then yous hould consider filing jointly as there are some benefits to doing this. One being it shows proof of relationship.

about the SSN, can he file one even if i'm still here in the Philippines? and also we read in the website that they need my immigration progress. . .im still on the USCIS stage, how will it work?. . .thanks very much for the information. . .guess we'll just have to file Zero. . .can i ask? when can he file his ITR? don't people file it like once a year?

Note, Hubby should NOT file the tax return as "Single" I have seen consulate in Guangzhou deny a visa over that, he can file Jointly with you using an ITIN
