I had my interview yesterday. It wasn't good or bad. She gave me a piece of paper and it says "Your case is being held for file review in order to prepare a decision. You will be advised by mail as to a decision on your application. No additional information is necessary from you at this time. However, if upon further review, additional information or evidence is required, you will receive a notice in the mail. Please respond to any request in a timely manner. Failure to do so, will result in denial of your application. Please allow 60 days from today's date before making an inquiry on your case".

What does this mean? Is it an approval or denial? So stressed out. Thanks

It sounds as though you were put under AR (Administrative Review). Just wait...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

You were the person who came through Canada without a US visa, right? We suggested that you provide all information to prove that you did enter legally... but you made it seem like you hadn't yet applied for AOS. Instead, your interview was only a week away. What proof did you show? What did you show initially, and what did you show now?

Sounds to me like your case is complicated and the IO needs to determine if they can adjudicate your case... if you are EWI or if you entered legally. That's tricky, and could take some time. You did have some court cases that seemed to indicate that you satisfied the requirements for legal entry, did you show that?

The interviewer was satisfied with the information that was provided like the canadian interview letter, the interaction with the CBP officer and the timing. She asked if there is any proof that I attended the interview. For that I never got anything written on my passport or any paper indicating I attended the interview. The canadian attorney got a denial letter. But I didn't carry that. Will I be able to provide later or can my attorney call the IO to submit it?

Usmalu - you don't need to submit anything unless it's specifically requested. The letter that was given to you after the interview states thast clearly.

Give it some time, they will notify you by mail if they need something from you. I have a feeling that you will probably be ok.

Usmalu - you don't need to submit anything unless it's specifically requested. The letter that was given to you after the interview states thast clearly.

Give it some time, they will notify you by mail if they need something from you. I have a feeling that you will probably be ok.

I got a letter saying I-130 is approved. Is this normal without the I-485 accompanied by it? Does this mean they gonna deny I-485? Please help. Thanks

Yes, it's normal. I-130 is a separate application. Keep on waiting, I think you will receive a decision about the I-485 very, very soon...I'll keep my fingers crossed!
