Calling all K-2 AOSers - past and present

Timeline

On advice of our accountant, and because we could use with the refund money ar the moment, we went ahead and filed our taxes without my daughters. Once we get their EADs and can get them SSNs, then we'll file the amendment. This way, we can also use this year's taxes on their AOS applications.

Okay so he said you can file for them even though they are not residents yet (having the GC)?

We're not including them yet - only when they get their SSNs and we file the amendment. But what I gathered from our conversation is they don't have to be citizens yet. One of the more complicated ways we could have gone about it is to request an ITIN for them and then file. No need for citizenship.

No I'm not talking citizenship I'm talking being a permanent resident (A Green Card holder)....

 

I know you aren't putting them on now but you say when they get SSN which they can get when they get the EAD. So that means your kids will NOT have their GC when you file for them. That's what I'm asking if that is allowed?

That is what we'll be doing, and from what the accountant said all we need is the SSNs.

 

I know it's been a very long time since, but when I lived here as a kid, under a J2 visa, my parents filed taxes with me and my brother included. None of us were citizens or green card holders, and we all had SSNs. It makes sense to me. You can be here legally, and not be a green card holder, and you still have to file taxes. So yes, I think LPR status is not needed. As long as you're legal and you have a SSN, you can file.

Okay I think we will try if we haven't gotten our GC approved by April under the resident alien for tax since we have been here over the 183 days.

In Part 3, Information on the Immigrant(s) you are sponsoring - given that each child will get its own package of forms, should I add the sister as an extra family member or leave the other family members section blank?

 

I tried asking in the main AOS forum but no one answered, so I´m hoping someone on here may know. Thank you!

I would write them on each other's so they get processed at the same time and don't get separated

Quick question for K2 paperwork photos: in the guides, it is suggested you write in the full name and A# in the back, but K2s don't have A# - should I simply write the names?

We sent our AOS, AP & EAD (k1 and k2) on 10th feb and they received on 13 th feb. But on 27th Feb uscis sent all our aos forms and documents sent  back with this is "rejection notice" of my k2 son. I signed in the "signature of person preparing form, if other than above" instead of "signature of applicant" thinking I am the preparer . 

 

But I dont understand what is priority date as it is mentioned in this form i-797c -"based on the information you provided, your priority date couldnt be established" i dont understand what does it mean. And also there is mentioned so many forms. i.e. i-130, i-140, i-360, i-526 in his i-797c .it made me even more confused. Do anyone know here which form should we send for the AOS of k2? I sent was

 i-485, i-131 , i-765 and his biometric.

Plz help. Thankx

All you do is fill in a new form for the K-2 sign the right place and send the whole package back to them with a new check. That's it.

 

I-485, I-131 and I-765. If under 14 the child does not pay for Biometric.

 

And forget the priority date here there isn't any the rejected the whole thing so it will be like started all over again and you will also get new case numbers.
