looking for some advice please..

I came to the US on a k-1 visa earlier this year, got married, and filed for AOS.

Due to not being able to get work and getting a job offer back in the UK, i left before my AOS came through to come back to England, my wife followed me a couple months later.

Now for various reasons we feel like we made a big mistake and want to go back to the U.S.

As far as im aware I have to re-apply for a spousal visa to go back to the US now, is this correct?

How long does this currently take, and will my wife have to return to the US to apply for me? I assume she cannot sponsor me if she doesn't have a job in the U.S.

I appreciate any advice.

Yes you will need to apply for a spousal visa. How long have you two been in the UK and is your USC wife residing there legally? If she's been residing there legally for more than 6 months, you can go the DCF route (filing directly via the embassy), which is much faster (2-4 months) than via USCIS in the USA (6-9 months).

In terms of financial support, you have three options:

- sponsorship on assets (savings, property etc)

- A US based co-sponsor

- Your wife lining up a job in the USA and returning as soon as the I-130 is filed with the embassy, then sponsoring based on her new job.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
