Hello!

Just a question here. I work abroad and it' an American company however, I don't have to file taxes in the states. But I do pay taxes (A LOT..freaking 20%) here in the Ivory Coast. What can I show to the consulate then? I make more than 125% of the 2009-2010 poverty line alone (without my husband's income). The problem is, in March I will be going on maternity leave. i still get paid even throughout the Summer. P.s. I'm a teacher. So even though we will be moving and I wont be in the country anymore we will still be getting my income from here. But how do I "show" that to the consulate? Any suggestions or ideas? Also, I was thinking about adding a family member from home as a joint sponsor "just in case".

Our Timeline:

Fall 2008- Met as friends while studying abroad

Nov. 2008- Started dating

Feb. 2009- Moved in together in Senegal

Apr. 2009- Got engaged

Aug-Dec. 2009- Long distance relationship from CA to Senegal

Dec-Jan. 2010- Christmas and New Years together in Senegal

Feb-May. 2010- Long distance (last time ever, no matter what!)

May 15th, 2010- Graduated!

May 20th, 2010- Moved to Senegal to live together

July- Moved to the Ivory Coast

August 20t, 2010- Married (YAYYY!!)

October- Found out we are having our first child in April!

December 22nd- Moved back to California due to political tension in the Ivory Coast

April 22nd- Our son was born

USCIS

June 3rd- Mail I-130

June 7th- NOA1 email/text

June 9th- NOA1 letter

October 3rd, 2011- NOA2

NVC

October 31st- NVC Case Number Recieved

Oct 31st- DS-3032 Emailed

Nov 21st- AOS Paid

Dec 22nd- IV Fee Paid

Jan 6th- AOS Packet Received

Jan 10th- IV Packet Sent and "False RFE" received

Jan 11th- NVC operator said AOS Packet was approved

Jan 24th- CASE COMPLETE!

A letter from employer should do.

As for the Affidavit of support, it WILL require proof of US Domicile.

The I-864 will need past year's IRS returns.

In many DCF cases the consulate may request a joint sponsor in the states, due to uncertainty of the petitioner after returning to the USA.

Are you sure you don't have to file taxes in the US? That would be highly unusual as you make over the poverty line. If you truly do not, a short letter explaining why, signed by you, will suffice.

If your income will only continue because you are on maternity leave and will then stop, the embassy may not accept this as "income which will continue after immigration"; look into that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If your income is over the poverty guidelines (presumably after you've converted your Ivorian income to dollars), then chances are that you ARE required to file tax returns with IRS too, no matter that you live and work abroad. You probably won't have to pay US taxes as you'll likely qualify for the foreign-earned income exemption, but you do need to declare this income to the US government.

IRS will not punish you if you file retrospectively, so I strongly suggest you look more into it and take action asap if needed. If you are required to file tax returns with IRS, then the Consulate will want to see your returns.

Also, I agree with Penguin. Your income has to be US-based to qualify. So it can only be used on the affidavit if it's going to continue from the same source while in the US and past your maternity leave. If this isn't the case, then you definitely need a co-sponsor.

If the same income is going to continue in the US (i.e. if you're going through an internal company transfer) then a letter from your employer stating that or a written job offer for the US (or even better, a signed contract) is good proof.

You may not be required to pay any US taxes but you are likely required to file a tax return. The US taxes on worldwide income.

If the income will not be continuing (your post is unclear as to whether you will be receiving income for the remainder of a term or will it continue on into the future) then it may not be accepted on the affidavit of support.
