You need an SSN for your wife. Filing joint will probably get you the largest refund or the least to have to pay. Run several scenarios (joint, married filing separate, etc.) to be sure.

George

thanks, will do, we already have her SSN, got it a while back :)

Also right after I got married I changed my status at work (the W2 tax form) to Married status so they can withhold less taxes from my check. If you are still showing "Single" at your job, they tax you pretty high just as any other Single filer.

Anyone hear if they are renewing the middle class tax cuts? or did they win on no for that one and only the rich get the tax cuts back?

What about if my K-1 husband doesn't have a SS? We tried to get one but we were too late - it was during the last week of his 90 days. Can I file for him even though he doesn't have a SS? Should I get an ITIN#?

Any advice is appreciated!

Remember that taxes are not due until April 15. If you file your AOS in time to get his EAD by, say, March 15, then you are fine (Allow a few weeks to get the SS card and reduce stress by cutting it close). Also, if you are due a refund, there is no penalty for filing taxes late. If that doesn't strike your fancy or you can't get an SSN by April 15, then I'd pursue an ITIN. Good luck.

You file your taxes.

The difference is how they compute your exemptions and withholdings from single to married. It's not a trick; it will just happen for you when you file your taxes.
