Will I have to start over? :(

Timeline

So, I have a couple questions. Here is my situation.

My husband is from Ireland and I decided to move to Ireland to be with him while the visa process was taking place. Our NOA2 was approved April 29, and all of our bills have been paid. The only thing we haven’t sent in yet is our I-864 packet. We have been waiting because since I’ve been here, He has gotten his old job back, which is a really good job, so it was more logical to stay here while at least one of us was employed.

So my questions are these….

Do we have turn the I-864 package in before April 29, 2011 (a year after we were approved) or will we have to start the process over again if we wait any longer?

Also, I’m thinking about going to medical school in the Caribbean in September, if I do this and we have already gotten everything approved will he be able to go with me, or will he have to stay in the States?

Any answers would be very much appreciated! Thank you

Typically NVC will hold a case up to 1 year.

How about calling them and asking about holding longer.

I chose medical school in the Caribbean because I graduated with my BS 2 years ago, took the MCATS in September, didn't do that well, and will retake it the end of January, Medical schools in the Caribbean have lots of agreements with hospitals in the USA and as long as I go to an accredited school it's a little less competitive and can be slightly cheaper.

So there lies my question, would my partner be able to live with me in the Caribbean if we end up going through the entire process?

Depends on the country in the Caribbean.

If it is a US territory or possession he should be able to stay with you. However, if it's a country other than a US state or territory he will not be able to live with you permanently at first. The intent of an immigration visa is to immigrate to the US. You can check on the exact residence requirements but I believe it is no more than 6 months out of the country in a 12 month period. Errrrrr I HATE the USA!!!! This entire ###### visa process makes me never want to come back! I was able to just go to the Garda station in Ireland with our marriage certificate and within 10 minutes I had a visa to stay because we're married. I understand that the USA is a different country and has to have harder regulations to get in but my god the entire process is ridiculous. I know it could be worse, we could have children or whatnot and I know thousands of people are going through this but, this entire process is very frustrating. All the rules and caviates, it makes it so hard to live a normal life ;( We just want to be together. The USA makes it seem like a crime to love and marry someone who isn't from the US.

Sorry for the rant, I'm just very frusterated (as I'm sure anyone reading this can tell)

Considering your circumstances, you might look into abandoning the process for now, and you two move to the Carribean (assuming an Irish person can do that reasonably easy), then get him a spousal visa via the local embassy (=DCF) in 4 years or whenever you are finished your studies.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That is a good idea Penguin_ie referring to the DCF process in 4 years BUT there is talk about discontinuing the DCF process altogether... which after reading the notes from the teleconference that took place on November 09, 2010 on Overseas Filing of Form I-130, Petition for Alien Relative, I don't believe it will happen real soon but who knows, this is the U.S. Government that we are talking about. :whistle: Anyway, Good Luck to you IRISH-LOVER with whatever path you may take!

Becareful of this because most Carribean countries consulars don't do DCF. :thumbs:

You will have to ask at the Consular level (call the embassy). Plus, going to school in a country don't always give you residence right either. In most Caribbean countries it is hard to even get a work permit, since their un-employment numbers are so high for their own people.
