What If the AOS is not done by Christmas?

Hi there,

quick question. My wife and I were married on June 3rd and applied for Adjustment of Status at the end of June. We are planning on spending Christmas in my native England, however what happens if my AOS is not done (and my Green Card received) by then? I know there are a good four months ahead and the biometrics are done, but still we want to book plane tickets now and don't want the stinking USCIS to screw things around...

Late Aug 01 - William takes part of a student exchange to Minnesota, USA and meets Amanda

Nov 01 - William comes to know Jesus. Life changes for the better and becomes fulfilling!!

Dec 01 - William flies home, but Amanda is the first person he misses and calls when back.

Mar 02 - Amanda and friends visit England and William

Summer 03 - William and Amanda email and phone

Nov 03 - William returns to the US. Over dinner he nervously tells Amanda he likes her.

Mar 04 - Amanda visits William in England; he surprises her with a trip to Paris.

Aug 04 - Over-worked Will misses his girlfriend so flies to see Amanda for a week.

Dec 04 - William flies to spend Christmas with much missed Amanda.

Mar 05 - Miraculously, God provides a way for Will to see Amanda as work sends him to US.

30th Apr 05 - At a coffee shop in Fargo, ND, William proposes to beautiful Amanda.

“What? Are you kidding me? What…?” Amanda shocked. But says “Yes!”

6th May 05 - Having assembled the paperwork, we post the I-129F to Nebraska USCIS

9th May 05 - NOA 1 – Our receipt is dated from the USCIS in Nebraska

12th May 05 - Our paper work is looked at.

16th May 05 - William leaves his fiancé to fly to England. Deep sadness. God is our strength.

25th July 05 - NOA 2

31st October - Medical

16th Nov 05 - Packet 4

19th Dec 05 - Interview at US embassy

24th Mar 06 - Will flies to the US via NY JFK POE

3rd JUN 06 - OUR WEDDING DAY!

29th Jun 06 - AOS applied for

24th Oct 06 - AOS interview

Timeline

You could apply for advanced parole (AP) which is a document that allows you leave but more importantly re-enter the US while your AOS is still pending. A planned trip back to the UK would be a perfectly acceptable reason for applying for AP. It might cost some money (I think $175 ??) but it will certainly be less than losing two trans-atlantic tickets. There is no refund if you don't use it but can you put a price on the peace of mind you'll get from knowing you'll be able to travel regardless of your AOS timeline ??

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am

Frustrating Process. Be happy that you two will be together for the holidays. So many VJ members hope they will be with their loved ones for the holidays. If you are able to travel other dates after xmas - go ahead and book them and if you can't use them most airlines let you use credit towards other dates if you cancel. Good luck and I hope your xmas plans work out.

8/02/06: Interview - Visa not recevied - put on AR "false hit" fingersprint check had to be done.

Have you applied for AOS yet?? If you haven' then just apply for the AP with it. If you already applied then apply for AP now as long as you have your NOA1 receipt. It may turn ou tto be a waste of money but if not at least you can go home for the holidays!!

Just apply for AP. You should have it by xmas if you apply within the next few weeks. In saying that you may get your GC by xmas but i wouldnt take the chance. Cute pic by the way.

How is your AOS going right now? You haven't put that in your timeline, but if you filed at the end of June its possible you could have your interview date before Xmas. I filed at the end of June and have my interview in October for example.

However if you don't want to risk it, this is what AP is for. Apply now and you should have it by Xmas, but don't be mad if you get your GC before then and the money is wasted! :)

thanks for your reply. I sent the whole bunddle of AOS application stuff which included the AOS, Application for work and the Advance Parole form. I received acknowledgement from the AOS and the Work forms, but not the AP. Is this normal?

Not if you filed at the end of June. You should have received your NOA1's for all three around the same time.
