Alright sooo, My boyfriend and I were thinking about getting married I'm from Canada and he's from the U.S and all of this visa stuff really confuses me.

If we get married in Canada and then get the CR1 visa how long will it take before I can come back to the U.S (I've been here since October 2010 and will be staying till April 2011) And in April he is going to come back to Canada with me and we are going to get married there so I'm wondering if I can get the CR1 visa here in the U.S? and if not how long will it take?

Please help!!

If you're gonna stay for a while in canada after you get married, you can apply for the spousal visa in canada through the American consulate, the other option is he goes back to the US and files for the Visa from there

Note, applying through the Consulate would take relatively less time than if he applied in the US

If you apply for the visa in Canada, your husband will have to be the resident of Canada. You can check the consulate website to find out what it means. If you can file directly to the consulate (which is refered to as direct consulte filing), this is usually much faster (for example, DCF in S.Korea only takes about 1.5 months).

This is incorrect. She obviously has to apply for the visa in Canada. He can only file the petition in Canada if he is a resident.

Corina Teresa - since I do not believe you entered with intent to marry, why do you not simply marry now and adjust status from visitor to tourist? however, to do so you must marry in the US. If this is not an option for you, when you travel back to Canada in October you may marry and he may file the petition for the CR-1 visa for you. If you go this route, it will be 10-14 months for you to get the visa.
