hi guys,

i would appreciate if any one can share some info about sponsoring a green card/permanent residency for my sister?

i am currently in the process of getting my citizenship ( interview set up on jan 6th 2011) , if i sponsor my sister who is in Virginia with her husband on H4 & H1 visas ,

should i file I-130 alone or

i -130 and I 485 together.

02-08-2011 Priority Date , receipt no: WAC000000000000

02-14-2011 I-130 fee check encashed

once you get your naturalization certificate at the oath ceremony, you can file the i130 for her. the problem is that siblings take more than 8 years to process, so they would have to be legal at all time with a work visa. because it takes so many years, she isn't an immediate relative, so you cannot file concurrently the i130 with the i1485.

if the visa ends, they have to return to their country, they cannot stay ilegally in the country. if they cannot maintain legal presence in the country, they will go through consular processing in her country of origin.

F4 family based is NOT eligible to do adjustment of status - they have to go through consular processing.

They Can go through the adjustment of Status, if they maintain a valid status within USA..
