Hello -

The mother of my boyfriend sent in an application on his behalf for a permanent resident visa last year. It is currently being processed and I am not sure where it is at only that they received the money for the application.

We wanted to do the fiance visa to get him over here but I have been told that you won't get approved for the fiance visa since his mother is already applying for the permanent resident visa. Is that true?? I am trying to get more information from his mother and their lawyer about where it is in the process. He is Jamaican and 25. Is there anyway of getting around the other visa or would it affect his getting approved for the fiance visa?

Untrue.

Good strategy to have more than application in at a time if you can.

is his mother a LPR or USC? if she is only residente, he can't marry, so that was a waste of time and money. if she is a USC the petition will take more than 5 years single and when he marries to you, more than 8 years, if she is a LPR more than 7 years.

as you can see, family petitons take a very long time.

Thankfully not ALL family-based petitions take a long time.. if it was the other way arouund (IR-5)the guy's mom would be here say in 8-9 months and WITH less questions asked at the interview and a much less stressful process. Family based category F2A is also very quick and easy and a few other categories.

The mother sent off the application last year for her son and is still being processed.. they are within the processing time for that category...!

YOU CAN petition for him if you want as a Fiance/Spouse.. it will NOT affect any application currently pendiing or approved at the USCIS stage. My Grandother Petitoned for my mother in July 2003 (F category 3rd pref) and in Feburary 2010 (7 years later) the case was not approved despite we having it moved all over the place. So We applied for my mother/father (IR-5 category) and the application was sent off in Feburary and they were approved for thier visa 9 months later on November 1, 2010)... did it affect the one that was still pending? No! Matter fact earlier in this year USCIS came out with a news release saying they will adjudicate (approve/Deny) any pending applicants or whatever the exact release said. When we were at the NVC stage the submitted I-130 from 2003 was apporved and is NOW at the NVC stage. We were going to cancel it but decided to leat it stay as my granmother wanted to see how long it would have taken.. you're free to go without problems.
