K-3 doing AOS instead of CR-1. What to send NVC?

I was going along with both K-3 and CR-1. My wife got her K-3 and is now in the US. I have decided to apply for AOS and not go with CR-1.

I understand that I am supposed to send a letter to the NVC stating that I will be doing AOS instead.

Questions:

1. What exactly am I supposed to say in this letter?

2. Is this letter supposed to be written / signed by me (Petitioner) or wife (Beneficiary)?

So how will NVC know that they need to send the file back to USCIS?

I'm pretty sure I've read somewhere on this forum that we need to send a letter to NVC if we're not going ahead with CR-1...

Just get all your docs ready and apply for the AOS, no need to send in a separate letter.

Ok, I haven't seen that post, and someone will pipe up if that's true, but I was in the same position as you, doing both CR-1 and K3, and made hte same decision to abandon CR-1 and go with AOS.

I sent in all the docs in June, did the biometrics end of June and have an interview scheduled for 11 September. I didn't send a letter telling them of the change in my plans, just the usual cover lettter with the application.

So, I would definitly get everything ready to go and send it in if I were you :)

You should notify NVC that you want them to transfer your I-130 to your local DO. Just a simple "we've decided to file AOS in the States rather than return to home country, please forward I-130 to XXXX office." should suffice. Include a photocopy of the NOA2 from your I-130.

I did write a letter to NVC to that effect (I was case completed at that time waiting for them to send the papers to the embassy); in the end I still received the packet for the embassy and NVC said they didnt receive my letter. I wrote the embassy a similar letter I sent to NVC.

I am now scheduled for biometrics.

Aug 29, 2005 - NOA-1 for I-130's received

Sep 13, 2005 - I-130's approved, petition forwarded to NVC

Oct 10, 2005 - I-864 Bill received by agent

Oct 12, 2005 - Paid I-864 Bill by Postal Money Order-$70 for whole family

Dec 17, 2005- checklist for I-864 received, reply sent back & entered into system on Dec 22.

Oct 20, 2005 - Alien spouse received DS-3032 (Choice of Agent) documents

Oct 24,2005 - DS-3032 sent to NVC (fr Phils)

Nov 17, 2005 - IV Fee Bill paid by Money Order & sent

Jan 3, 2006 - Mailed DS-230 to NVC

Jan 4, 2006 - DS-230 entered into system

Jan 12, 2006 - CASE COMPLETED, and still waiting!!!

Aug 3, 2006- schedule of interview at US Embassy-Manila. Won't be showing up.

K3/K4

Aug 30, 2005 - Mailed I-129F to Chicago(wife's)

Sep 10, 2005 - NOA-1 for I-129F

Oct 19, 2005 - I-129F Approved (email notice), received mail Oct. 28

Nov 2, 2005- Received K3 approval notice

Mar 24, 2006 - K3 interview

Apr 4, 2006 - Visas in hand

May 8, 2006 - arrived in America

AOS

August 2006 - mailed I-485 forms

September 2006 - Biometrics done

December 2006 - Interview; Green Card received by mail a week later

2007: Applied for kids' certificate of citizenship, got the certificates in June & passports in August 2007

My wife is here on a K-3 and we never notified NVC. We filed her AOS at the end of March and her interview is in a few weeks.

I don't believe it really matters if you notify them or not.

August 22/08: check cashed (certainly did not waste any time)

September 11/08: Received NOA 1

September 15/08: Rec'd Biometrics Appointment Letter

October 02/08: Biometrics Completed

March 04/09: File transferred to CSC

June 01/09: Letter stating Petition Approved and Card Production ordered

July 12/09: Card Production ordered e-mail

July 13/09: Received card in the mail

March 27/06: Sent I-485

March 31/06: NOA 1

April 4/06: Rec'd NOA 1

April 5&6/06: Touched

May 4/06: Rec'd Biometrics Appointment Letter

May 23/06: Biometrics Appointment

Beneficiaries: CaseNo. FirstName LastName DOB: mm/dd/year

CaseNo. FirstName LastName DOB: mm/dd/year

CaseNo. FirstName LastName DOB: mm/dd/year

The beneficiaries have entered the United States on K3 and K4 visas on mm/dd/year through <Port of Entry>. They will apply for adjustment of status. I would like to request that this be noted on their respective case records and retain their files until a CIS office requests it to process their adjustment application.

Good afternoon !

I'm here on a K3, I've posted about my situation, it was complicated, but me and my husband are finally together. Thanks for all the advice, it was so helpful.

I still have a problem with all the paperwork I need to send for the AOS process. My I-130 is still pending. I would like to apply for the work permit and AOS as soon as possible, but I'm confused about what to send instead of the approval notice for I-130. Do I need to wait for the approval?

If somebody was in the same situation, please help me. I need a list of everything I need to send. I've read the guide and the sample forms, but they are filled out for a K1 visa.
