Hi all,

well here we go,

I met my Current wife in April 2009,

in Octorber 15th 2009 I flew out from England to USA to be with my Current wife,

I was there for 89 days and came back to England, i then Stayed in England for 4 weeks and then flew back out to the USA,

we both got married in feb 16th 2010, and started sorting out my paperwork for immagration that I needed,

with needing paperwork as well from England which took its time to get hold of,

I was left with no choice but to leave the united States as my stay was already comming to a close on the 88 day mark

I came back to England on may 8th and been here ever since,

My wife applied and filed for my K3 1-29F and my I-130,

on the july 29 2010 with the uscis,

the whole package went to chargo lock box,

it then went to the USCIS and was accepted and then got sent to Califonia service center, in which its been sitting pretty on Intal review ever since,

and then it got posted to Texas service center, on november 3rd

and now December 3rd its gone back to the USCIS

just this process alone has taken 6 months,

so my question to you all, is where do we go from here, whats the next step, I know the NVC has to be in this Paper trail somewhere,

and if this process has taken 6 months already then how long is the NVC going to take,

I've already been selling up my appartment while i have been waiting, and i've been trying to work out my expected time date so i can pack the rest of my stuff here that i use every day to send to the usa,

I know that there is a Medcail and the Visa interview which if i am right are the 2 last things on this road,

Do you have your USCIS approval? If you do, then begin calling NVC to get your case number and go from there. From USCIS your petition will go to NVC which will take about 2 months to complete.

After than the interview will take place

Your I-129F will be closed at NVC - it is a dead path to take to a spousal visa

Hi all,

well here we go,

See the CR1 Guide by clicking on the word Guides at the top of any page here. Prepare for the NVC stage of that process as you WAIT for your I-130 to be approved. Both petitions will go to NVC and NVC will administratively close the I-129F, killing the K3 visa path.

Thank you both for your Replies,

the whole case is still in the USCIS hands,

The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you.

The I129F PETITION FOR FIANCE(E) was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you

They are both under Initial Review,

they are both still pending at this moment and time,

you both brought up that the K3 I-129f will be cut off at the NVC, I was kinda hoping to take the K3 route as i havent got a Co sponsor as of yet who can also sign jointly with my wife, i had one but he let me down when my wife and i was gathering all the paperwork up ready to send,

wouldnt this make it even harder and longer going with the I-130 then it would to go along with the K3 route,

I was left with the impression that you get to decide as to which path to go along, either k3 or I-130,

ok so if i have no choice in this matter and the K3 is clossed off and i'm only left with the I-130 whats the drop down list as to whats to be done etc etc, as i know pretty much the K3 route but not 100% sure as to what is what with the I-130,

thanks in advance,

just for infomation my wife and i have been doing this alone,

and so been scratching our heads and learning fast :)

See bold above. Get rid of that impression. It's a false one. As already mentioned, start by clicking on the word "Guides" at the top of any page here and study carefully.

You're I-129F will most certainly be closed at NVC as has been the case for almost a year now. Sorry to inform you but you are on the cr-1 route
